In the name of God Amen: I JAMES BABER of Wythe County, Virginia being weak in body and of perfect mind and memory thanks be given unto God calling unto mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last Will and Testament Viz: Principally and first of all I give and recommend my soul into the hands of Almighty God that gave it and my body I recommend it to the earth to be buried in a decent Christian burial at the discretion of my Executors, nothing doubting but at the general resurrection I shall redeam the same again by the mighty power of God and as to any such worldly estate wherewith it hath pleased God to bless me in this life I give and devise and dispose of the same in the following manner and form; I first give and bequeath to my sons JAMES BABER, JOEL BABER and DANIEL BABER and MARY UNDERWOOD, ELIZABETH DRAPER, FANNIE HOLBY and MARGERY HENLEY, I allow each one of them one shilling sterling in twelve months after my death. Interlined before signed. Secondly I give to my daughter JOHANNAH BABER one half of my old plantation where James Cocks now lives on to be divided by my executors, equally divided in quantity and quality and thirdly I allow my daughter NANCY HOBBS`s son RICHARD HOBBS the other half, JOHANNAH BABER being allowed her preference in choice of the land. I do hereby ordain and appoint Ewing & William Gleaves my sole executors of this my last Will and Testament as witness my hand and seal this 4th day of June 1798. JAMES BABER, his seal. Witnesses present; Matthew Gleaves, James Ewing, Absolom Gleaves. At a court held for Wythe County the 10th day of July 1798 this last Will and Testament of JAMES BABER Decd was proven in court by the oath of Matthew Gleaves and Absolom Gleaves, two of the witnesses thereto and ordered to be recorded.
