John Bathy signed a noncupitive will for James Bagnall in 1702 in Isle of Wight Virginia. It was also signed by a Francis Parker who lived on a farm known as 'Macclesfield' which is on an inlet for the James River near Hampton Roads. His neighbor was the Bagnalls. In a later testimony about Bagnall's son, he was quoted as telling the son "not be a knave and disavow you father's will if it comes from abroad". He mentions the conversation was held in Bathy's house and he signed the testimony indicating he was literate. For him to use this language and be literate is somewhat inconsistent with beind an indentured servant. It was not unusual for land grants to be requesed many years after the individuals arrived. It was also not unusual for groups of land speculators to band together to obtain land. Who knows but the group who are listed on the land patent were very active in North Carolina land trades in subsequent years.Most of their activity occured just south and west of English John's Gates county home.His home was just east of the Merry Hill location they acquired.
