Will of Sallie FOWLKES Box - Humphreys County, TN. - 1895

o       Posting this to the Box site in hopes of collateral families input and to share what information I have on the Box family. Within this communication there is the will of “Sallie Box” wife of Moses Mason Box of Humphrey’s County. I would like to share information with the Box/Folks/Jackson families, or anyone who may have information about these families. I believe these families are intermarried and closely related and migrated from South Carolina to Tennessee and on to Florida.
o       Any help would be greatly appreciated.

To start I sorted the Sarah/Sally/Box in the Humphreys County, Tennessee area, as I was looking for my Sarah/Sallie/Sally JACKSON.
o       Tracking Sarah (Sallie) Jackson/Folks/Warren/Box
o       
o       The daughter of Able Jackson and Clarissa TOMLINSON Jackson.
o       Wife of
o       1)Jacob Folks
o       2)T.M. Warren
o       3)Allen Box
I believe the following will to be of Sallie FOWLKES Box who was the wife of Moses Mason Box of Humphreys County, Tennessee. Moses Mason Box being the son of Allen Box and Sussanah Isabella HARMON. The children named in the will of Mrs. S. J. Box are John W. Byrn, Lettetia Box, Moses, Put, and Mattie.

Will of Mrs. S. J. Box
I S. J. Box a feme sole of Waverly Humphreys County Tennessee being of sound and disparing mind and memory do hereby make and publish this my last will and testament hereby revoking and making void all others by me at any time made.
First. I direct all of my just debts be paid by my executor as been as practicable. Second. I hold a note of M. M. Fowlkes secured by M. F. Fowlkes, R. W. Fowlkes, and W. H. Fowlkes of date of April 14, 1894 payable to me one day after date for the sum of nine hundred dollars upon which sum payments have been made but to secure said note. Said M. M. Fowlkes promised and has so told me that he has conveyed to me by fee simple deed a tract of land of about 35 acres lying in Dyer county Tenn and bounded on the North by Hayrus heirs land. South and East by Biffle and West by Ferrel heirs. Now if the said M. M. Fowlkes should pay off said note within a reasonable time from this date then I give will desire bequeath and return all of said land to the said M. M. Fowlkes but should he fail so to do within a reasonable time then said land I give desire and bequeath to my son John W. Byrn for and during his natural life only and upon his death to his heir. But upon said note being paid within a reasonable time from which I do not release the said Fowlkes should I have to take said land then the proceeds of said note. I direct my executor who is also appointed Trustee for that purpose to take such sum and invest the same in land taking title to my said son John W. Byrn for and during his natural life only and at this death to go to his heirs. But in whichever way the said M. M. Fowlkes fund may come into the hands do my executor I direct that it go to or be invested in land for my said son John W. Byrn during his natural life and upon his death to go his heirs.
Thirdly. All the rest and residues of my estate both real personal and ????? I desire as follows:
To my children John W. Byrn and Lettetia Box I give and bequeath an equal share. To my son Mose I give eighty dollars less than an equal share. To my son Put I give three hundred and forty dollars over and equal share and to my daughter Mattie three hundred dollars over and equal share. I do this for Mattie and Put that they may be made equal to the others in their opportunity for securing and education, the forty dollars sum that I give Put than Mattie however is for money I owe him.
Lastly. To carry out the provision of this will I nominate and appoint B. R. Thomas my executor thereof In testimony whereof witness my hand this the 25th day of May 1895.

Administrator’s Bond
State of Tennessee, Humphreys County
We J. R. Fowlkes are bound to the State of Tennessee, in the penalty of Twenty Five ($2500.00) dollars, Witness our hands and seals, this 2nd day of July A. D. 1895.
The condition of this obligation is such, that whereas, the above bound J. R. Fowlkes (underneath the name hand written – “with the will annexed”) has been appointed Administrator of the estate of Mrs. Sallie Box deceased.
Now if the said J. R. Fowlkes shall well and truly, as such Administrator perform all the duties which are or may be required by law, this obligation shall be void, otherwise to remain in full force and virtue.

If that is true why would J.R. Fowlkes be the administrator to Sally Fowlkes/Byrn/Box will?

1850 Census - Tennessee, Humphreys County, Jacob Folks 40 (1810) born NC listed as Carpenter, Sarah Folks 31(1819) born TN, John Folks 10 (1840) born TN, William Folks 8 (1842) born TN. Also listed in household John Tolls 17 born in TN listed as an apprentice carpenter.

o       I believe this is my Sarah Jackson daughter of Able Jackson and Clarissa TOMLINSON. She is married to her first husband Jacob Folks(Fowlkes).

Revolutionary War Papers for Stephen Jackson – Wife Nancy COOK Jackson – 5272
Jacob Folks giving oath that he has been acquainted with Nancy Jackson the widow of Stephen Jackson. That she is of high character and truth.
Stephen Jackson is the Revolutionary War Solider known as “Killin Stephen” He was married to Nancy COOK in South Carolina. His children identified in the petition for pension are William Jackson and Able Jackson. Able Jackson is married to Clarissa TOMLINSON and one of their daughters is Sarah/Sally/Sallie JACKSON the one who first marries Jacob Folks. I believe the Jacob Folks who is giving testimony for Nancy COOK Jackson is her grandson in law.

Does anyone know the parents of Jacob Folks (Fowlkes)? Does Jacob Folks (Fowlkes) connect in anyway to Sarah FOWLKES/Byrn/Box(wife of C.M. Byrn and Moses Mason Box)

Sallie Byrn married to Moses M. Box – 31, December 1871 – A.C. Stockard, M.G.
This is Sally FOWLKES Byrn Box who first marries Cyrus Mack Byrn and second marries Moses Mason Box.
She has a child with C.M. Byrn – John W. Byrn
The other children Moses, Put, Mattie, Lettetia are fathered by Moses Mason Box.

o       This is Sarah JACKSON Folks who was married to Jacob Folks. I have not found any death of Jacob but can only assume he is dead as she is remarrying and also the reference to her in her father’s will (Able Jackson). She is referred to as “Sally Warren”.

Will of Able Jackson list his children - one being "an equal share to Sally Warren, I will and bequeath fifty dollars, and to John Folks and William Folks after their mother Sally Warren receives fifty dollars for them to receive the balance of her share so that them and her may have one childs part of my estate."

o       This is Sarah/Sally/Sallie JACKSON/Folks/Warren/Box listed as a child with her two living children John and William Folks. The father of these children is Jacob Folks her first husband.

Have not found the death of T.M. Warren but Sallie JACKSON/Folks/Warren marries Allen Box.

This is Allen Box with his wife Sarah JACKSON/Folks/Warren/Box. Moses Mason Box is in the household. Allen’s son.
o       Allen Box buried in the Box Cemetery in Humphreys County, TN. Born – December 25, 1801 South Carolina Dies – March 28, 1876 Humphreys County, TN.

Sarah Box 66 (1814) widowed born in TN, John Folks 40 (1840) son born in TN married to Sarah Folks (daughter in law) 24 (1856) born in TN, and Anderson Folks 3 (1873) years old born in TN. also in the household Sherwood Shafer 20 and Micheal Shafer 18 both listed as Laborer born in TN.
This is Sarah JACKSON/Folks/Warren/Box daughter of Able Jackson and Clarissa TOMLINSON with her son John Folks and daughter in law Sarah (ELLIS) Folks, and grandson Anderson Folks. Sarah Box is listed as a widow. This is the widow of Allen Box who dies in 1876.

Richard W. Fowlkes 25 with wife Fanny W. Fowlkes 23 and children Carrie W. Fowlkes 4 Martha F. Fowkles 2 Eva Fowlkes 5m Elva Fowlkes 5m and also listed in the household is a nephew John W. Byrn 12 years of age (born around 1868). A teacher by the name of Martha Robinson 46 is also in the household.

I am not sure who the Richard W. Fowlkes is although John W. Byrn is the son of C. M. Byrn and Sallie FOWLKES Byrn. Sallie is now married to Moses Mason Box and is listed in the household with Moses and their children.
Is this Richard W. Fowlkes the brother to Sallie FOWLKES/Byrn/Box? How do they connect to Jacob Folks/Fowlkes? How does Richard W. Fowlkes connect to John Randolph Fowlkes?

Other Humphreys County, Tennessee families are also appearing in this area.

o       This is John Randolph Folks/Fowlkes/Falks husband of Sallie ELLIS Folks/Fowlkes/Falks and their three children Anderson W. and Lowella and Willie K. Also listed in the household is the grandmother Sallie BOCKS(Box). This is Sarah/Sally/Sallie JACKSON/Folks/Warren/Box.

This is where I stop finding Sarah/Sally/Sallie JACKSON/Folks/Warren/Box. I would like to know where she is buried. Or if anyone has any other information about this Sallie Box?
Ironically, it appears Sarah/Sally/Sallie JACKSON/Folks/Warren/ Box dies close (between 1885 and 1895) to Sarah/Sally/Sallie FOWLKES/Byrn/Box who dies in 1895 in Humphreys County, Tennessee.

Does anyone know the connection to these two Sarah/Sally/Sallies Box?

Unfortunately there isn’t a 1890 Census, however; the will of Mrs. S.J. Box indicates there is an administrator to the will by the name of J.R. Fowlkes. I believe this J.R. Fowlkes is John Randolph Fowlkes and is connected to the Sarah/Sally/Sallie Fowlkes in some way.

Sarah (Sallie) JACKSON/Folks/Warren/Box not in the household with son John Randolph Folks and family; however, the William K. Jackson family is living next door(son of Uriah Jackson and Maragret Clark). Uriah Jackson and Sarah/Sally/Sallie JACKSON are brother and sister and children of Able Jackson and Clarrisa TOMLINSON. William K. Jackson is listed as a “phosphate miner”.
