In Lewis Hunnicutt's will, he says "I also give in trust, to my brother-in-law, James Coldwell, two hundred dollars ($200.00) for the purpose of using for the comfort to the said servant Milly."Lewis Hunnicutt's will was written the 11th day of July, 1849.James Caldwell, Sr.'s will was probated in 1844 where he mentions "heirs of James Caldwell, Jr." as if James Caldwell Jr. were dead already. So weren't both these James Caldwells dead before Lewis Hunnicutt wrote his will? Then why is he giving him $200?Can anyone explain this??????Does it have to do with the phrase "in trust?"
James Caldwell, Sr.'s wife was referred to as "Sally" in his will, and while it's true that "Sally" was a nickname for Sarah, I don't think James Caldwell, Sr.'s wife was Sarah Hunnicutt.I think that Sarah Hunnicutt was the wife of James Caldwell, Jr.I could be wrong, but I will explain why I think this.
According to the will of Lewis Hunnicutt, he mentions a sister Sarah "Coldwell" and mentions nephews Adolphus Franklin Coldwell and James Buchanan Coldwell.Although he doesn't state directly that Adolphus and James are his sister, Sarah's, sons, I think that they are.I think this is them in Giles County census records:
-------------------------
1850 census, Giles Co TN
-------------------------
Sarah Caldwell age 40 -------->(indicates born ca 1810)
Adolphus 21
James 17
-------------------------
1860 census, Giles Co TN
-------------------------
Sarah Caldwell 57 ------------>(indicates born ca 1803)
James B. Caldwell 25
-------------------------
According to the 1840 Giles County, TN census, James Caldwell, Sr.'s wife, Sally, was born between 1770 and 1780.So this Sarah Caldwell living with Adolphus and James B. in the 1850 and 1860 census can't be her since she was born about 1803-1810.
Also, Sarah Hunnicutt Caldwell's mother, Elizabeth Hunnicutt, was living with her (Elizabeth's) son, William Hunnicutt, in the 1850 Giles County census. She was 86 years old which would make her born about 1764.This PROBABLY makes her too young to be the mother of James Caldwell, Sr.'s wife, Sally, who was born between 1770-1780 (but not impossible; Elizabeth would have been 16 in 1780).
James Caldwell, Sr.'s children with Sally were all born by 1823 (I think Greenville/Granville was the youngest and he was born ca 1823).So Adolphus Franklin and James Buchanan were YOUNGER than all of James Caldwell, Sr. and Sally's children, not OLDER as they would had to have been if they had come from previous marriages of Sally to a Buchanan and another Caldwell.

From "Giles County Will Abstracts 1814-1900," page 17-18, abstract of will of James Caldwell, Sr.
Will written 1844; To wife Sally Caldwell tract of land, perishable property, slaves, Houston, Molly, Sally and Daniel. At wife's death, slaves to be divided among children, with the exception of Alexander and Granville Caldwell, they are just to have $100 each from entire estate.Robert Caldwell, tract of land purchased of John Snipes.Slaves to be divided equally among following children: Margaret Tucker, Susan Campbell, Mary Daugherty, Elizabeth Tucker, Robert, Jefferson and Jackson Caldwell and heirs of James Caldwell, Jr.Son Claiborne to share with the above children.Executors:Robert Caldwell and son-in-law Joab Campbell.Witnesses:D.J. Moore, H.S. Goldsberry.Probated 1844
**********************
I thought that this meant that Claiborne was a son of James Caldwell, Sr., not an heir of James Caldwell, Jr.It says "Son, Claiborne to share with the above children."I thought that the "above children" referred to the heirs of James Caldwell, Jr. and meant that his own son, Claiborne, was to have only a grandchild's portion.
If this is right andClaiborne is not an heir to James Caldwell, Jr., it would mean that James Caldwell, Jr.’s heirs could have been Adolphus Franklin Caldwell and James Buchanan Caldwell, which would mean James Caldwell, Jr.’s WIFE was Sarah Hunnicutt, not his MOTHER.
