John Day - Hamilton County, Indiana - Civil War????

Attempting to find out what Indiana regiment this particular John Day may have been in. He was born in 1810 and died in 1863. The 1863 year makes me wonder if he might not have been killed in action, though his name and a photo of him in military uniform appears on findagrave at Fishers Cemetery, Hamilton County, Illinois.

Know that his wife's name was Nancy and that he had a daughter Cassandra (Day) Health.

Any help would be appreciated.
