Will of Moses DeGraff:

In the Name of God Amen the twenty fifth day of September one thousand seven hundred and Ninety Nine. I Moses De graef of fishkill town being weak in body but of perfect mind and memory thanks be given to God therefore calling into mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this to be my last will and testament that is to say principally and first of all I Give and recommend my soul unto the hands of God that gave it and my body I recommend to the earth to be buried in decent Christian burial at the discretion of my executors nothing doubting but at the General resurection I shall receive the same again by the mighty power of god and as touching such worldly estate wherewith it hath pleased God to bless me in this Life I give devise and dispose of the same in the following manner and form that is I give and bequeath to Anna my beloved wife all my house hold Goods and moveable effects also to have the possession of all my real estate where on I now live During her Life. -
I give and bequeath unto mu son Michael De Graef and to his heirs the Lot of Land he now Lives on called the undivided lot except such a parcel as shall be left to my daughter Hester Wife of Aron Cole which said lot left to said son Michael contains about one hundred Acres more or less - I Give and bequeath unto my two sons Moses De Graef and Barnet Degraf and to their heirs the farms and Mills I now live on containing about two hundred acres more of less to be equally divided in quantity according to Nature of the lands and improvements so that each as near as possible may have an equal part.
I give and bequeath unto my son Abraham Degraef and to his heirs one hundred and twenty five pounds seven Shillings and Six pence lawful money of New York. - I give and bequeath unto my daughter Dicantia Wife of Cornelius Delameter and to her heirs one hundred and twenty five pounds seven shillings and six pence like money as above. I give and bequeath unto my Daughter Elizabeth Wife of Baltus B Van Kleeck and to her heirs one hundred and twenty five pounds seven shillings and six pence like money. I give and bequeath unto my son Semion Degraef and to his heirs twenty five pounds seven shillings and six pence like money aforesaid with his Note returned to him for the sum of fifty pounds which the said Semion gave unto the said Moses. - I give and bequeath unto my Daughter Anna Wife of William Hicks and to her heirs one hundred and twenty five pounds seven shillings and six pence like money. I give and bequeath unto my Daughter Hester Wife of Aaron Cole and to her heirs twenty four Acres of Land twelve of which said Cole has in his possession and twelve acres more Joining the same and to be the same with With the lot he now lives on and to run westerly along the lands of Daniel Huffman untill it shall contain the last mentioned twelve acres also the sum of fifty three pounds seven shillings and six pence like money as above mentioned - I give and bequeath unto my daughter Sarah Wife of Jonathan Jacocks and to her heirs one hundred and twenty five pounds seven shillings and six pence like money - All the above legacies to be paid by my three sons Michael, Moses and Barnet and to be paid in the manner following Zy Michael to pay one third Moses one third and Barnet one third and shall be paid to the heirs as follows one third to be paid one year after the Decease of my said Wife Anna if she survives me one third two years after and one third three years after without Interest for the payment of which legacies my Real Estate stands bound but if my said Wife shall not survive me then in the same proportion after my decease. Be it also remembered that my son Moses Degraef is bound in a Note with Baltus B VanKleeck in the sum of twenty six pounds into Thomas Rosekranse and in case the said Moses does or had to pay the whole or any part of said Note then and in that case so much shall be stopped out of my Daughter Elizabeths portion with Interest - Also there shall be no accounts brought against my estate by any of my Children unless it is from under my hand. I also constitute make and ordain My sons Abraham Degraef Michael Degraef Semion Degraef Moses Degraef and Barnet Degraef my executors with my Wife Anna an executrix of this my last will and testament and I do hereby utterly disallow revoke and disanull all and every other former testaments will Legacies and bequests and executors by me in any ways before named and bequeathed notifying and confirming this and no other to be my last Will and testament. In Witness whereof I have hereunto set my hand and seal the day and year first above Written Moses DeGraef {LS} Signed sealed published pronounced and declared by the said Moses DeGraef as his last will and testament in the presence of the subscribers John Terpenning Moses VanKleeck John M Cooke. Be it remembered and known to all men by these presents that whereas I Moses DeGraef of fishkill town in Dutchess County farmer have made and declared my last Will and testament in writing bearing Date the twenty fifth day of September one thousand seven hundred and Ninety Nine. I the said Moses Degraef by this present codicil do ratify and confirm my said last Will and testament and do give and bequeath that lot of Land or lands lying or adjoining the farm of my son Semion Degroff and on the east side of a small run of water - running by said Semions house and Joining the lands of Isaac Hagermann [ ]ut=oher and the lands of John Green not heretofore mentioned in my said last Will unto my two sons Moses DeGraff and Barnet DeGroff to be equally divided between my said sons Moses and Barnet and all other of my Lands joining said lot that shall not be covered by deed or quitclaim unto my said sons Moses and Barnet and my Will and meaning is that this Codicil or schedule be and being adjudged to be part and parcel of my said last will and testament and that all things herein mentioned and contained by faithfully and truly performed and as full and amply in every respect as if the same was so declared and set down in my said last will and testament Witness my hand and seal this twenty ninth day of April one thousand eight hundred Moses DeGraef {LS} Signed and sealed in the presence of us Thomas P Cooper Peter Van Kleeck Jur John M Cooke .....[section containing witnesses' affidavit omitted by submitter]...
The People of the state of New York by the grace of God free and independent To all to whome these presents shall come or may concern find greeting. Know ye that at Poughkeepsie in Dutchess County on the twenty eighth day of october in the year of our lord one thousand eight hundred before Gilbert Livingston Esquire Surrogate of our said County the last Will and testament of Moses De Graef deceased (a copy whereof is hereunto anexed) was proved and is now approved and allowed of by us and the said deceased having whilst he lived and at the time of his death Goods Chattels or Credits within this State by means whereof the proving and registering the said Will and granting administration of all and singular the said Goods Chattels and Credits and also the auditing allowing and final discharging the account thereof doth belong unto us the administration of all and singular the Goods Chattels and Credits of the said deceased and any way concerning his Will is granted unto Abraham De Graef Michael De Graef Simion De Graef Moses De Graef and Barnet De Graef five of the executors in the said Will named they being first duly sworn will and faithfully to adminster the same and to make and exhibit a true and perfect inventory of all and singular the said Good Chattils and Credits and also to render a just and true account thereof when thereunto required - In testimony where of we have caused the Seal of the Office of our said Surrogate of the said County at Poughkeepsie the fourth day of November in the year of our Lord one thousand eight hundred and of our independence the twenty fifth - Gilbert Livingston.
