DYKE and JONES Families of Culpeper and Rappahannock Cos. VA

I'm posting what information I have on the DYKE and JONES families of Culpeper and Rappahannock Cos., VA. This is very much still a working file and in no way polished! I'm still working on census information for many of the families. Please contact me if you have any additional information on any of these people or if you have any corrections. I am also interested in the MANUAL family from the same area of VA. I have included my sources for all the information and have tried to indicate what is speculation. If there is no source listed, the data most likely came from census reports. All census research has been placed in the "NOTES" section for each person.

Any information on who the father of Absalom and Otheniel JONES could be is most welcome. I have Stephen JONES listed as their father, but that is pure spectuation. Court records indicate that Rebecca DYKE married both a James JONES and a Stephen JONES. Marriage records show only a marriage to James JONES. There is only one Stephen JONES in Culpeper Co. and so far it seems that he is not connected to Rebecca. Of course, that doesn't mean that he wasn't the father of her two boys. Any thoughts on this would be appreciated.

Humbly complaining show unto the court your Orator and Oratrixes Horatio G. MOFFETT, Willis BROWNING, Willis MONROE, and Hetty MONROE, his wife, Silas J. MONROE, Sarah C. MONROE, Lewis A. That a certain Nathan DYKE died intestate in the county of Culpeper about thirty years ago, seized in fee simple of one hundred and fifty-two acres of land situated in that part of the county of Culpeper which now constitutes a portion of the county of Rappahannock, leaving a widow named Hetty DYKE, and ten children who were his heirs at law namely George DYKE, Sally DYKE who subsequently married Henry NASH, Hester DYKE who afterwards married John NETHERS, Nancy DYKE who married Hezekiah GREY, Rebecca DYKE who married Stephen JONES, Samuel DYKE, Lydia DYKE, Deborah DYKE who afterward married Anderson WRIGHT, Susan DYKE who afterward married Lewis JENKINS and David DYKE, that a suit in chancery was constituted in the county court of Culpeper in the year 1832 for the purpose of allotting dower of the said land whereof the said Nathan DYKE died seized to his said widow Hester DYKE and of dividing the residue of the said land among the said children and heirs at law of the said decedent, and the descendants (several of them having died previous to that time) in which suit in the year 1833 forty acres of the said land was allotted to the said widow Hester DYKE for ____?___ and the residue divided among the ____?____ as will appear by a copy of the report of the ___?___ in said suit to make such allotment of Dower and division which said copy of said report is here with exhibited marked A and prays to be taken as a part of this bill your orator and oratrixes further show that the said Anderson WRIGHT and Deborah WRIGHT his wife by ___?____deed dated the (big ink smear) the day of November 1831 and admitted to record in the Clerks office of the county court of Culpeper on the 1st day of March 1832 (a copy where of is herewith exhibited marked B and prayed to be taken as part of the bill) conveyed to a certain Silas JENKINS all their interest in the said tract of land that the said Silas JENKINS departed this life in the winder or spring of 1832 having duly made his last will and testament in writing which was admitted to probate in the county court of Culpeper on the 19th day of March 1832 an authenticated copy of which said will is herewith exhibited marked C and prayed to be taken as part of this bill that the said Silas JENKINS in and by the said will and testament gave to his son Lewis JENKINS one half of the interest he owned in the estate of the said Nathan DYKE deceased and gave the other half to your orator Willis BROWNING in trust for the sole use of the testators daughter Hetty MONROE and her children, that the wife of the said Silas JENKINS with whose support the devisees of the said __?___ was charged, is dec'd, that the husband of the said Hetty MONROE is your orator William MONROE and the children of the said Hetty MONROE are your infant orators and oratrixes. Your orators and oratrixes further show that the said Susan DYKE a daughter of the said Nathan DYKE married the said Lewis JENKINS the devisee of the said Silas JENKINS in the year 1833 and that the said Lewis JENKINS in the year 1834 or 5 abandoned his wife and when last heard from which was some ____?____ eight years hence was in the state of OHIO leaving his wife in this county where she resides, without making any provision for her support. DYKE reside in the county of Rappahannock and the last two of whom are infants under the age of twenty-one. that the said Samuel DYKE one of the sons of the said Nathan DYKE by his deed dated the 10th day of August 18_2 [date is smeared] and admitted to record in Culpeper County court on the 19th day of August 1832 conveyed all his interest in the said tract of land of which the said Nathan DYKE died seized to a certain James GREEN in trust for certain purposes in the aid deed ___?___, a copy of which said deed is here with exhibited marked D and prayed to be taken as part of this bill; that the said James GREEN in ___?__ of the said trust sold the said Samuel DYKE'S interest in the said tract of land to a certain Daniel MASON for the sum of fifty dollars and twenty-five cents, and conveyed the same Daniel MASON by his deed admitted to record in the clerks office of the county court of Rappahannock County on the 14th day of December 1835 in ___?___B, page 326; that the said Hezekiah GREY and Nancy GREY his wife (the said Nancy being one of the daughters of the said Nathan DYKE) by their deed dated the 10th day of September 1833 and admitted to record in the clerks office of the county court of Rappahannock County on the 5th day of November 1833 in Folio A, p. 158, conveyed all their interest in the said tract of land of which the said Nathan DYKE died seized; to the said Daniel MASON; that the said Lydia DYKE one of the daughters of the said Nathan DYKE by her deed dated the 24th day of May 1834 and admitted to record in the clerks office of the county court of Rappahannock county on the 6th day of June 1834 [smear] A, page 340 conveyed all her interest in that part of the said tract of land of which the said Nathan DYKE died seized which was allotted to his said widow Hester DYKE for her dower to a certain Gabriel TUTT; that the said Gabriel TUTT and Jane C. his wife, by their deed dated the 25th day of September 1835 and admitted to record in the clerks office of the county court of Rappahannock county on the 20th day of October 1835 in Folio B, page 291, bargained and sold to the said Daniel MASON all their interest in the said tract of land allotted to Hester DYKE for her dower, which was conveyed to the said Gabriel TUTT by the said Lydia DYKE as aforesaid; that the said Rebecca JONES one of the daughters of the said Nathan DYKE and a widow of the said Stephen JONES by her deed dated the 10th day of April 1835 and admitted to record in the clerks office of the county court of Rappahannock County on the day and year aforesaid in Folio B, page 140 conveyed to the said Daniel MASON all her interest in that said tract of land of which the said Nathan DYKE died seized which was allotted to his said widow Hester DYKE as her dower; that the said John NETHERS and Hetty, his wife (the said Hetty being on of the daughters of the said Nathan DYKE) by their deed dated the 24th of April 1835 and admitted to record in the Clerks office of the county court of Rappahannock County on the 2nd day of July 1835 (Folio B, page 201) conveyed to the said Daniel MASON all their interest in that part of said tract of land of which the said Nathan DYKE died seized which was allotted to the said Hester DYKE as dower. MOFFETT in___?___ of the said trust sold all the interest of which the said Daniel MASON was entitled in the said tract of land of which the said Nathan DYKE died seized to a certain Elijah CHEEK and conveyed the same to the said Elijah CHEEK by his deed dated the 9th day of February 1841 and admitted to record in the clerks office of the county court of Rappahannock on the 10th day of February 1841 in Folio D, page 130. that the said Elijah CHEEK and Polly his wife by their deed dated the 10th day of February 1841 and admitted to record in the clerks office of the County court of Rappahannock on the 25th day of February 1841 in Folio D, page 143, conveyed to the said Horatio G. MOFFETT all their interest to which the said Elijah CHEEK was entitled in the said land of which the said Nathan Dyke died seized. Your Orator and Oratrixes further show that the said Hester DYKE the widow of the said Nathan DYKE died in the summer of 1843, whereby the persons interested in the said land allotted to her as her dower of the lands of her deceased husband became entitled to the possession of the said land; that the persons ____?___interested in the said dower lot of land are your orator Horatio G. MOFFETT who is entitled to six tenths thereof as the ___?___purchase of the interest of the six children of the said Nathan DYKE as aforesaid; Willis BROWNING who is entitled one-twentieth of the said dower land in trust for the said Hetty MONROE and her children aforesaid, Lewis JENKINS who is entitled to one-twentieth of the said dower land; Susan JENKINS who is entitled to one-tenth thereof, the children of Sally NASH here before named who are jointly entitled to one-tenth thereof; and the children of George DYKE herein before named who are jointly entitled to one-tenth thereof. Your orators and oratrixes further show that the ___?___of each of the heirs of the said Nathan DYKE in the said lot of land whereof he died seized would not exceed the value of three hundred dollars and that a division of each of the said heirs in that portion of the said tract of land which was allotted to said Hester DYKE as her dower aforesaid would not exceed the value of thirty dollars, ___?___ that is would be to the interest of the said heirs and those entitled to the said dower land, that the same should be sold and the proceeds thereof divided among those entitled thereto; but a sale cannot be effected without the aid of a court of equity in consequence of some of the aid heirs being infants others ____?____, In tender consideration whereof and for as much as your orators and oratrixes are without remedy at law and are ___?__ in a court of equity where matters of this sort are properly ___?___ to that end. Therefore that the said James W. DYKE, Susan DYKE, John FINCHAM and Nancy FINCHAM, his wife, Jonah PALMER and Frances PALMER his wife, Lewis JENKINS and Susan JENKINS his wife, James NASH, Phoebe NASH, Samuel NASH, Johnson DYKE and Albert DYKE may be made parties defendants to this bill; that the adult parties may answer the same from oath, and the infant defendants may answer the said bill by their guardian as ___?___ to be appointed by the court; that the said forty acres of land which was allotted to the said Hester DYKE as her dower of the lands of her deceased husband as aforesaid may be decreed to be sold and the proceeds of the sale be divided among those entitled thereto according to the several and respective interest therein; that your orator and oratrixes may have such other and ___?___ as the facts of the case ___?____ and to the court may seem ___?___may it please the court to grant to your orators and oratrixes the commonwealth writ of subpoena. The Subpoena awarded in this cause being returned executed on the defendants James W. DYKE, Susan DYKE, John FINCHAM and Nancy FINCHAM, his wife, Josiah PALMER and Frances PALMER, his wife, and Susan JENKINS and two months having elapsed as well since the return day thereof as the filing of the bill, and they are still failing to appear and answer the said bill and on the motion of the plaintiffs the bill is taken for confessed as to them, and the defendants Lewis JENKINS and James NASH who are absent from the state of Virginia and against whom the plaintiffs appear to have proceeded by publication in the newspapers and at the Court House door in the manner prescribed by law in relation to absent defendants still failing to appear and answer on the like motion of the plaintiffs bill is taken as confessed to them and this cause coming on to be heard upon the bill of the plaintiffs and the exhibits therewith filed and the answers of the infant defendants Phoebe NASH, Samuel NASH, Johnson DYKE, and Albert DYKE by William J. MENEFEE their guardian as litem appointed by the court was argued by council upon consideration whereof the court doth adjudge order and decree that Willis BROWNING who is hereby appointed a commissioner for that purpose having first advertised the time, place, and terms of sale for four weeks at the door of Rappahannock court House in Sperryville, Flint Hill, and Woodville sell at public sale to the highest bidder upon a credit of twelve months the land in the bill mentioned, which was allotted to Hester DYKE dec'd as her dower of the lands of her deceased husband taking from the purchaser bond with approved personal security, and retaining the legal title as a further security for the payment of the purchase money and the said commissioner is directed to report his proceedings herein to the court in order to a further decree.

The undersigned who was appointed a commissioner to execute the forgoing decree, respectfully reports that in ___?___ thereof after having advertised time, place, and terms of sale for four weeks at the door of Rappahannock court House in Sperryville, Flint Hill, and Woodville, according to the direction of the said decree, he sold at public sale to the highest bidder with a credit of twelve months on the 15th day of February 1845 at the door of Rappahannock court House the land in the said decree mentioned which was allotted to Hester DYKE as her dower of the lands of her deceased husband and H. G. MOFFETT being the highest bidder became the purchaser of the said land at the sum of two hundred dollars and executed by his bond therefore with approved personal security according to the terms of said decree which said bond as a further security to the payment of the purchase money all which is respectfully submitted. To Nancy GRAY the wife of Hezekiah GRAY her one tenth part of the ___?___ therefore have allotted lot No. 1 containing 13 acres. To Rebecca JONES widow & relict of James JONES, dec'd.., late Rebecca DYKE we have allotted lot No. 2 containing 12 acres. To the heirs of Sarah NASH lot No. 3 containing 12 acres. To Sam'l. DYKE lot No. 4 containing 13 acres. To Susanah JENKINS the wife of Lewis JENKINS lot No. 5 containing 12a. To Lydia DYKE lot No. 6 containing 12 acres. To the heirs of David DYKE, dec'd., lot No. 7 containing 10 acres. To Hetty NEATHERS the wife of John NEATHERS lot No. 8 containing 10 acres. To Deborah WRIGHT lot No. 9 containing 9 acres. GENERAL DYKE NOTES:

There was a John DYKE (d. 1678) who was living in the Part of Old Rappahannock Co., VA, that is now Essex Co. His will mentions his 2nd wife Esther and a son named John. John, the son, married Mary SHARP. Their son John married Judith PARR. John and Judith may have had 5 children (speculated in Tylerís Quarterly, Vol 17, p. 107). Boulward died unmarried; John, died 1758 unmarried; a daughter possibly named Judith who married John MINTER; a son who married Susanna and apparently died childless; and a son who married Mary (possibly Mary REEVES). This unknown son who married Mary evidently died young leaving her with seven children: James, Jackson, Bowler, Elizabeth, Judith, Susannah, and Mary. A response to the above query was posted by Lori Olson (oreolorio@yahoo.com) on 22 October 2000. I have some references to the same John DYKE from the Tylerís Quarterly. The information I have says that he was married to Judith WEBB rather than Judith PARR. And, although we have not yet been able to prove it, so far, we believe John DYKE (brother to Boulware) to be the husband to Judith LEWIS. We think this likely because Goochland Co. is near Essex County and the names/dates are matching up. Boulware had a son named John as well that died single.

From Nola M. ROGERS - her e-mail to me dated 28 December 2000:

Nathan DYKE first appears in the extant records as a tithable in 1770 (as DICK) in Loudoun Co., VA. The list included several other men with the surname of DYKE or variant spelling of DICK. George and Nathan DYKE also appear in the 1782 personal property Tax list of Loudoun Co., VA, the first year in which such taxes were assessed. The first mention of George DYKE in what is now Loudoun Co., VA, appears to be the record of the assignment to him of 150a by Thomas LAMB in 1766.

10 June 1798 - James ?, Edward PENDLETON, and John JETT sell to Nathan DYKE of Culpeper Co. for 19.15.0 pounds 33a part of several tracts of land in Culpeper Co. the property of George Calvert (?) JONES. (Deed difficult to read and I did not understand it all) Culpeper Co., VA, DB T, pp. 392-3)

Information about the wife of Nathan being a PYOTT is shown by oral history as recorded by Mary Nethers NOYSE (poss. now deceased) and a documented court case of 1844 by a bill which says in part "...that the said John NETHERS and Hetty his wife the said Hetty being one of the daughters of the said Nathan DYKE." Nola indicates that this record would be in Culpeper, Madison, or Rappahannock Cos. In 1844 Hettie was living in Sperryville, VA, which is in Rappahannock Co.

"Upon beginning my ancestral search, I found a yellowed paper in a box of things from [my] deceased grparents titled 'History of Nethers Family' In it reads "The great-grandmother of these heirs (Nethers) on the Kike side was a French lady named Hettie PIOT, who was on an excursion vessel to America when the captain, upon arrival, offered all for sale who refused to pay transportation charges. When she was put up to the highest bidder, a man who knew her demanded the captain to take her back to her native country or he would be punished. He agreed to do so, but she was afraid to return for fear he would drown her." Hettie's parents are documented in a court case in 1844 which says in part that Hettie NETHERS was the daughter of Nathan DYKE and Hettie PIOTT. The PIOTT family may be French Huguenot.

To the worshipful County court of Rappahannock County in Chancery sitting, respectfully complaining sheweth unto the Court your complainants Vincent SMEDLEY and Nancy his wife late Nancy JONES of the County of Warren.

The separate answer of Becky JONES in her own right & as Admx. of James JONES, dec'd., to a bill of complaint filed in the county Court of Rappahannock County by Vincent SMEADLY and Nancy his wife, late Nancy JONES, complainant against her and others defendant.

This respondent reserving to herself all benefit of exception to the said bill for answer thereto, or to as much thereof as she is advised it is material for her to make answer unto answering says That it is true, as stated in the said bill that James JONES departed this life in the year 1814 seized and possessed of a small real estate, of about 63 acres and of a small personal estate appraised at (pound symbol) 74.19.6. leaving herself his widow, and two infant daughters (Nancy the complainant, and Hetty DYKE) his heirs and distributees. And that she qualified as his Admx. in the same year. And that the said personal estate consisting of household furniture & farming stock and utensils, the use of which [were] indispensably necessary to the comfort and support of herself and daughters, she did not sell but retained it in kind, for their use, and maintenance. And this respondent further answering says that from and after the death 9f her said husband, it was only with the most arduous labor that she was able to support herself and helpless daughters, as she was wholly dependant upon her own labour [sic] until a few years past since her sons born to her after the death of said husband, have become large enough to aid her in labours, by whose she has been enabled gradually to clear about twenty acres more of said land of which only twenty years (?) was cleared and tillable at the death of her said husband. And by such exertions she was enable to raise to womanhood her said daughters Nancy & Hetty at a cost to her beyond the annual rents and profits of their portion of the said estate real and personal as well as to pay off the debts of her said husband, amounting to the sum of about ? And this respondent further answering says that is at all times willing to such division of the said land, as is prayed for by the said bill - But she denies that these any ? of personally or objects to distribution, as alleged in said bill. For that the costs and expenses of the raising of her said daughters was far greater than the rents & profits of their portions of said estate or of the annual interest of the pe.?.onalty had been turned into money and she is advised and insists that until the reached the age of twenty one years of age she had
the right to apply the annual rents and profits of this estate to this support even if not allowed to charge them with the real cost to her of their support, which exceeds those annual profits.

And this respondent further says that her said daughter came to 21 years of age in the year 1830 and her said daughter Hetty in the year 1835 and that since that time until recently upon their respective marriages, they continued to live with and upon her ? to contribute by their labor to their own support and that ? with a full knowledge, based upon her repeated declaration, that she would charge them for their board and maintenance. And she is advised and insists that from and after this becoming of age, she was not united in her demand upon them & this estate to the amount of profits & interest upon their said estate, but is entitled to charge and to receive from them full compensation for the expenses and cost to her of their maintenance and that what she is entitled to charge and demand of the said complainants for the board of the said Nancy from and after became of age, and which she does charge and demand of them for the space of ____(space
left blank)___ for excesses any sum that the said complainants can ? to claim for this ? of the said personal estate. And she respectfully insists upon her claim ? the board and maintenance of the said Nancy as an offset to the claim set up against her, by the said complainant.

And this respondent further answers says that she being in fact a ? of the said complainants, and wishing to avoid tedious litigation, insists upon another defense, ? to the suit and prayer of the complainants by an act of the general assembly made and passed ? about 1826 entitled an act for limitation of actions against personal acting in a financiary capacity and this ? and for other purposes it was enacted. that all actions suits and motions at law or in equity founded upon bond executed by executors, administrators, guardians, committees of idiots and lunatics, sheriffs, deputy sheriffs, sergeants, deputy sergeants, clerks, deputy clerks, and other persons acting in a fiduciary notation? within public or private, shall be instituted or brought within ten years, next ? the right and cause of actions shall have accrued and not afterward; saving? to infants, idiots and lunatics, persons non ? and ? covert, five years after their disabilities shall cease."

And this defendant avers that she qualified as Admix. of James JONES in the year 1814 and that more than ten years have elapsed since the right of action of the said Nancy against her as such administration, accrued, and she otherwise ? that the said Nancy came to the age of twenty one years in the year 1830 and that more than five years has elapsed since the ? disability of infancy under which the said Nancy labored, at the time that her said right of action ? ceased, before the filing of the said bill of complaint, and she ? that the said complainant was under no other of the disabilities mentioned and directed in the said act of the general assembly except that of infancy, prior to or at the time of her coming of the age of twenty one years. all which matters & she ? to be true, and is ready to prove, and she claims the benefit of the said estate and insists and claims that it is a ? to the? part of the said bill as such to ? anything from her by
reason of her administration upon the estate of the said James JONES, her ? liability being by ? of the ? which she ex? as Admix. in pursuance of law & ? having fully answered she prays to be hence dismissed with her reasonable costs, in this behalf most wrongfully expended.

This indenture made the 10 day of April in the year of or Lord one thousand eight hundred and thirty five between Henry NASH of the County of Rappahannock and State of Virginia of the one part and Daniel MASON of the county and state aforesaid of the other part witnesseth, that the said Henry NASH for and in consideration of the sum of twenty five dollars to him in hand paid by the said Daniel MASON, the receipt whereof is hereby acknowledged hath granted, bargained and sold and by these presents doth grant bargain and sell unto the said Daniel MASON his heirs and assigns a certain tract or parcel of Land containing twelve acres lately allotted to Sarah NASH late Sarah DYKE by Commissioners appointed by the County Court of Culpeper for dividing the real estate of Nathan DYKE dec'd which tract or lot of Land is known in the plot of said division as lot No. 3 and assigned to him as his part of two thirds of the tract of Land formerly the property of the said Nathan DYKE dec'd also all his interest in the other third of said tract of Land, which by the same commissioners allotted or assigned as Dower to Hester DYKE widow of the said Nathan DYKE, dec'd., with every appurtenances thereunto belonging unto the said Danl MASON to have and to hold the said lot of Land of twelve acres and the interest in the Dower to him the said Daniel MASON his heirs and assigns during the natural life of him the said Henry NASH and the said Henry Nash for himself and his heirs does covenant and agree that he will warrant and defend the title to the same unto him the said Daniel MASON his heirs and assigns during his natural life free and clear from the claim or claims of himself and his heirs and free and clear from the claim or claims of all and every other person or person whatsoever. Her husband was the son of Silas JENKINS. According to the Chancery Suit in Rappahannock Co. concerning the distribution of the lands of Nathan DYKE and Hester's dower land, Lewis abandoned his wife in 1834 or 1835 and "when last heard of some eight years hence" he was living in the state of Ohio. He had left his wife residing in Rappahannock Co., VA, without making any provisions for her support.

The residences above appear on the map as located across the road and down a bit from each other on the 214/274 (can't tell if it is a 7 or 1) just east of Mt. Williams P.O. at the intersection of the Hardy Turnpike (#420). Geo Dyke is on the north side of the road and to the east of Johnson Dyke just before the Mrs. A. S. Brill residence. Johnson Dyke is on the south side of the road east of Geo. Dyke and just west of J. Fauver's residence. (1885 Frederick County Atlas).

Thanks so much for all the responses. I will be a little more specific -- I understand my great grandparents lived at Mt. Williams - Johnson and Anna Rebecca McDaniel Dyke and both were buried at Old Reformed Cemetery in Conicville. I first thought they were buried near Mt. William. I have not been able to find where this Old Reformed Cemetery is. I am somewhat familiar with Conicville. From a previous note I learned Johnson did show up in the 1885 Frederick Co Atlas in Back Creek Magl. District along with George Dyke. I wonder if any of these residences are still standing or if these specific areas could be identified.

A message posted 18 July 1999 by Fred DYKE on the DYKE Family Genealogy Forum states: "My ggg grandfather, Johnson DYKE, was born in 1827 and was living in that area of Virginia in the 1850 census. His mother was Frances DYKE who died in a fire in Frederick County, VA, on 3/21/1875. I do not know the father of Johnson but his grandparents were Nathan and Hester DYKE. There was a Nathan listed in the 1787 census in Culpeper County. There also was a son named Nathan and he may be the missing generation."

To the worshipful county court of Rappahannock County in Chancery sitting, respectfully complaining sheweth unto the court your complainants Vincent SMEDLY and Nancy his wife late Nancy JONES of the County of Warren.

That sometime in the year 1814 a certain James JONES of the county of Culpeper departed this life intestate seized of a tract of land lying in the said county in that part now within the limits of the county of Rappahannock adjoining the lands of Francis WILLIS, George M. PARSONS, Willis MONROE, and others containing about [space left blank] acres leaving a widow Becky JONES and two infants of very tender years, his heirs at law to whit Nancy who has intermarried with your orator Vincent SMEDLY and Hetty who has intermarried with DAVID DYKE, which said David DYKE and Hetty his wife your complainants as informed, has by deed conveyed all their interest and estate in the said tract of land to a certain Othniel JONES of the county of Rappahannock but which deed is not yet of record in this court and your complainants further shew to the court that administration upon the personal estate of the said James JONES was granted on the 17th day of October 1814 by the county court of Culpeper to the said Becky JONES who entered into bond conditioned according to law and that Abner SIMS now of the county of Rappahannock was her security in the said bond all of which will more fully appear from a certified copy of the said grant of administration and of the bond aforesaid filed herewith as exhibits marked A and B which your complainants pray may be taken as part of this bill and your complainants further charge that by virtue of the grant of administration aforesaid, the said Becky JONES became possessed of a very considerate amount of personal property as by a paper headed "an inventory of the Personal estate of James JONES, dec'd." and returned to and recorded as such in the county court of Culpeper as from a certified copy of which filed herewith an exhibit (and prayed to be taken as a part of this bill) marked C will more fully appear by which said paper which your complainants charged is an appraisement also as the names subscribed there unto are those of three of the appraisers of the personal estate of the said James JONES, as by a certified copy of the appointment of appraisers of the said estate by the county court of Culpeper, filed herewith as an exhibit marked D and prayed to be taken as a part of this bill will more fully appear. By which said exhibit marked C it appears that the personal estate of the said James JONES, dec'd., amounted to the sum of 74.19.6 and although your complainants have caused the records of the county court of Culpeper to be examined, they are informed and charge that no settlement of the said Becky JONES account of administration upon the estate of her intestate can be found, but as your complainants charge and believe that the said James JONES was little if at all indebted at the time of his death, there is a very considerable fund for distribution in the hands of said administrator of which your complainants are entitled to one third part under the statute of distributions, but your complainants not being able to effect a settlement of the said accounts of administration, or to procure a partition and division of the land aforesaid are advised that an application to a court of chancery is necessary to secure to them the rights vested in them by law.

In tender consideration whereof and for as much as your complainants are without adequate remedy at and by the ___?___ and direct rules of the law and cannot have adequate relief save in a court of equity where matters of this and a like nature are properly cognizable and reliable your complainants therefore pray that the said Becky JONES in her own right and as administratrix of the said James JONES, Abner SIMS as her security, David DYKE and Hetty his wife, and Othaniel JONES may be made defendants to this bill and may file true direct and perfect answers make to all and singular the matters henceforth stated and charged and that not only to the best of their respective knowledge and remembrance but also to the best of their several and respective information, hearsay, and belief, that Commissioners may be appointed to allot and assign to the said Becky JONES her dower in the lands aforesaid, that the portions may be made of the residue of the said tract of land between your complainants and the said Othniel JONES in right of the said David DYKE and Hetty his wife, and that a settlement of the account of administration by the said Beck JONES upon the estate of the said James JONES here intestate which has or which ought to have come to her hands may be directed by the court, and all other accounts which may be necessary and proper and that your complainants may have such other and further setup as the nature of the case may required and so the court may ___?___meet to the end therefore they pray that a subpoena may issue and ____?___. Where as a certain Vincent SMEDLEY of the County of Warren by a certain indenture bearing date on the twenty eighth day of June 1844 and admitted to record in the clerks office of Rappahannock county court on the same day in Book F, page 38, did grant bargain sell and convey unto the said Robert M. HETERICK his heirs and assigns all the estate right, title, claim and demand of him the said Vincent SMEDLEY of in and to the real estate of James JONES, dec'd, together with all and singular the appurtenances thereinto belonging and the rents, ? And profits thereof per? To secure the payment of a sum of money therein specified to the said Willis BROWNING and in the event of the said sum of money or any part there of being unpaid on the first day of January 1845, the said Robert M. HETERICK was empowered to sell and dispose of the said estate and interest conveyed to him by the deed aforesaid upon the request of the said Willis BROWNING his executor administrator or assignee. And where as the said Vincent SMEDLEY total failure to pay the sum of money $70 together with the interest thereon secured by the deed afore said and the said Robert M. HETERICK being thereunto requested by the said Willis BROWNING proceeded to make sale of the said estate on the thirteenth day of July 1845 having first given more than three weeks notice by advertisement of the time, place and terms of sale in the town of Washington and other public places, at which sale the said Willis BROWNING being the highest bidder for said estate became the purchaser at the price of thirty dollars and who has since requested that estate aforesaid so purchased by him may be conveyed to the said Othaniel JONES by the said Robert m HETERICK. Now this indenture witness that the said Robert M. Land consisted of his interest in the 187a of land known as the Absalom JONES Tract. This deed was a deed of trust and it also had something to do with a harvesting/threshing machine mentioned in the above deed of 25 July 1878 - The deed was difficult to read and I did not understand it all. There was a deed dated 6 December 1882 in which Middleton and his wife were mentioned. Barbara F. is mention in this deed as the daughter of George SANTMYERS. Her mother's name was given as Cella SANTMYERS, widow of the before mentioned name. Deed was difficult to read. Barbara is also named as the wife of Middleton MORRISON.
