Posted by: Patricia Vincent (ID *****0430) Date: March 31, 2002 at 09:34:07

This is from TRYON COUNTY DOCUMENTS 1769-1779 A North Carolina County, by Kathy Gunter Sullivan, 2000, p. 198:
Christian Aker, NC Archives CR.060.801.8 filed as EAKER. The original will is not written in paragraphs and the estate papers still exist.

(abstracted-pv) In The name of God, amen, I Christian Aker of the County of Tryon, NC, planter, being very sick
and weak...but of perfect mind.....Christian burial, etc.

First I give to Eve, my dearly beloved wife...bed, furniture, etc. and one third of my whole estate exclusive of my lands......

I give to my well beloved son Peter Aker all the land on the so. side of the creek....the other part to be to Christian Aker....To my son Christian Aker...then to be equally deposited among my three sons viz. Peter Aker, Christian Aker & Daniel Aker...

I give to my well-beloved daughter Barbery Aker the sum of ten pounds of our said province currency; also to my well beloved daughter Catherine Aker the sum of ten pounds...All such estate be equally divided among my dearly beloved children.....make and ordain Peter Aker Sen(,) Christian Carpenter Sen & John Aker sole executors of this my last will & testiment....set my hand a & seal this twenty fifth day of June in the year of our lord 1776
Christian his X mark Aker

In presence of us, ....William Graham; Barbery her mark Aker; Mary her X mark Aker.

Notes->pv:
1. There must have been two Barbery Akers since wasn't it understood that someone who was to inherit could not be a witness to the will? The given names Barbara/Barbery and Catherine were often used in many German families.
Since the daughters were referred to in the will as Akers, probably they were not married when this will was written, June 25, 1776.

2. Can anyone PROVE that this Barbery, daughter of Christian, WAS or WAS NOT the wife of Cornelius Aker/Achord/Acord? Cornelius and Barbery married in 1784. Cornelius was in Frederick Co MD before moving to
NC after the Revolution.
