Simply put, the object of the lawsuit was to settle the estate of John Hodsoll, father of Bennet. Even had Mary Freeman lived in 1631, she was not a descendant of John Hodsoll and stood to inherit nothing from him directly. The matter did not concern her.
The date of Edmund's second marriage has been posted here before. Prior to 1984, it was known that he and his new wife appeared on a passenger list of 1 Jul 1635, with Bennet's children but (apparently) none of Elizabeth's. Hence it was argued that if they did produce a daughter Mary, she was probably born in America. This is the position adopted by N. Grier Parke II, _The Ancestry of Lorenzo Ackley and His Wife Emma Arabella Bosworth_, ed. Donald Lines Jacobus (Woodstock, VT: Elm Tree Press, 1960), p. 25-6, which no one has cited yet. These writers also believe that Mary Perry was Freeman's daughter on onomastic grounds.
