No 43.....This Indenture made this twenty third day of November in the year of our Lord one thousand Eight hundred 9 four Between Willian Telghnam (Tilghnam ?) & Peter Stephen Dupancean Esqrs, Abm Kintzing , Junior, George Warrell & Tench Coxe by Peter Fisher, their attorney. in fact one part and John Halbert of the county of Rutherford of the other part. Witnesseth, that the said William Telghnam (Tilghnam), Peter Stephen Dupancean, Abraham Kintzing Junior, George Warrell & Trench Coxe for & in cosideration of the sum of fifteen dollars to the said Fisher for then in hand paid for the said John Halbert the receipt and payment where is herely acknowledge have bargan, sold, and conveyed and confirmed & by these present do bargarin sell covey & confirm unto the said John Halbert and to his heirs and assigns forever a certain tract piece or parcel of land in the county of Rutherford on the head of Alston creek including his oun inprovement begining at a hickory on the east side of a branch below his house and his own old corner running thence South seventy four East 58 poles to a small hickory on the side of a mountain in or near his own line then south thirty three west fifty eight poles to a double chesnut then North Eighty two west 67 poles to a chestnut then north 20 west 60 poles to a stake then North 30 east 38-- to a stake, then to the begining containing 50 acres with all way, woods, water members and appurtandances to the same belonging in any maners appertaining to the said John Halbert to his heirs and assighed forever To have and hold the said pieces parcels of land and with all its member and appertaning to the said John Halbert and to his heirs and asigns forever. To have and to hold the said piece or parcel of land with all its members and appertucmier to occupy possess and enjoy the same free and clear of any lawful encumbance and the said Trench Coxe doth hearby covenant and agree to and with the said John Halbert that he the said Coxe will defend the said land and premises to Halbert and to his heirs assigns forever the lawful claim of any person or persons whatever . In Witness whereof the said Fisher hath-here to sets the names and offixed the seals of the William Tighman, Peter Stephen Dupancesy, Abraham Kintzing, Junior, George Warrell and Trench Coxe on the day & year first above written.
