1. JOHAN1 KRAUS was born March 03, 1824 in Grossseelheim, Hesse, Germany, and died April 16, 1887 in Manchester, Carroll county, Maryland. He married HELENA WINK, daughter of JOHN WINK. She was born December 25, 1825 in Bremen, Germany, and died August 04, 1913 in Manchester, Carroll county, Maryland.

In the name of God, amen. I John Kraus of Carroll County, in the state of Maryland being sickly and
weak in body, but of sound and disposing mind,memory and understanding, considering the certainty
of death and the uncertainty of the time thereof, and being desirous to settle my worldly affairs, and
thereby be better prepared to leave this world when it shall please God to call me hence, do therefore make and publish this my last will and testament , in manner and form following that is to say;
First and principally, I commit my soul into the hands of Almighty God and my body to the earth to be decently buried at the descretion of my Executor hereinafter named and after my debts and funeral charges are paid. I devise and bequeath as follows:
Item - My will and desire is that at my death both my real and personal property to belong unto my dear wife Helena Kraus and to remain in her hands the same as during my lifetime and so to continue to belong unto her, both real and personal property until her death, when at her death my Executor hereinafter named shall disperse off at public sale of all my property, both real and personal and the proceeds arising therefrom shall be equally divided among my following named children = Christian H Kraus, Lewis Kraus and Mary Ellen Kraus share and share alike.
But provided that if my dear wife Helena Kraus shall at anytime before her death desire to sell either the real or personal property or both , it is my will and desire that this shall be done, and the proceeds from either such a sale after my debts are paid shall be equally divided among my three children herebefore named and I further desire that at my death, my dear wife Helena Kraus shall pay and provide for all debts incurred by me during my lifetime and shall continue to pay the taxes and fire insurance , but of the proceeds of my farm if possible for her to do. And lastly I do hereby constitute and appoint my son Christian H Kraus to be sole Executor of this my last Will and testament revoking and annulling all former wills by me hereafter made ratifying and confirming this and none other to be my last will and testament.
In testimony whereof I have hereunto set my hand and affirmed my seal this 28th day of June in the year one thousand eight hundred and eighty six.

On the 2nd day of May 1887, before the Orphans Court of Carroll County came John R Sheng, and in open court made oath in the Holy Evangel of Almighty God that the above instrument of writing is the true and whole last will and testament of John Kraus late of Carroll County, deceased that he received it from the testator in his lifetime for safe keeping and that he does not know of any other will or codceil left by said deceased.

On the 2nd day of May 1887 before the Orphans court of Carroll County came Charles F Keck, Peter Barles and John R Sheng the subscribing witnesses to the aforgoing last Will and Testament of John Kraus late of Carroll County, deceased and in open court made oath on the Holy Evangely of Almighty God that they did see John Kraus the testator insaid will named sign and seal said will. that they heard him publish, announce and declare the same to be his last Will and Testament: that at the time of so doing he the said testator was to the best of their apprehension, knowledge and belief of sound and dispensing mind, memory and understanding, and that they subscribed their respectful names as witnesses to said will at the request of the testator in his presence and the presence of each other.

The court after having carefully examined the above last will and testament of John Kraus, late of Carroll County, deceased, and also the evidence adduced as to its validity, orders and decrees this 2nd day of May 1887, that the same be admitted to be probate in this court as the time and genuine last will and testament of the said John Kraus, deceased.
