According to newspaper reports, Washington Allen Whitaker did, indeed, kill the bartender at the Planter's Hotel in New Orleans on Jan.7, 1836. He was tried and convicted and sentenced to death. He proclaimed his innocense of murder, saying that he killed in self-defense. While in jail, an attempt was made to free him, but this failed. Later, he left a note proclaiming self defense and committed suicide. He did not want to be hung. He was given an elaborate funeral and burial on the Whitaker family's plantation by the grave of his father, Col.Aquilla Whitaker.
