John Lancaster was attached to answer Hardy Allard of a plea of Covenant broken, damages one thousand dollars, whereupon the said Hardy Allard by Bennett Searcy, Gentleman, his attorney, at November Term 1799, files his declaration upon this same, in the words following viz.Metro District Declaration, November Term 1799... Hardy Allard, by his attorney Bennett Searcy, Gentleman complains of John Lancaster in custody of the Sheriff etc of a plea of Covenant broken, etc for that whereas on the 14th day of April 1789 in the County of Davidson the said John Lancaster did then and there sign with his own hand and sealed the same, by the name of John Lancaster his covenant and delivered the same to the aforesaid Hardy, and did then and there covenant and agree to and with the plaintiff that he would under the penalty of one hundred pounds current money of the State of North Carolina convey to the said Hardy Allard by good and sufficient deed in fee simple fifty acres of land adjoining the said Lancaster (pg. 445) David Rounsafer and John Barrow lands, as soon as the right could be obtained from the Secretary's office. Which said Covenant the plaintiff here brings into Court, dated the same day and year aforesaid. [Wednesday Declaration]... The plaintiff further declares that the said defendant hath long obtained a right for the aforesaid land from the state of North Carolina and hath had it fully and completely in his power to comply with his aforesaid Covenant. And the plaintiff further declares that the said defendant hath not made a Deed of Conveyance agreeable to his said Covenant and neither has he made to him a title to the aforesaid fifty acres of land nor complied with his said Covenant in any manner whatever, when in fact the plaintiff saith that he hath complied with all and every part of the said Covenant which on his part he was bound, yet nevertheless the said defendant his said Covenant made and entered into as aforesaid, not in the least regarding hath not made and executed a Deedto the fifty acres of land (50 acres) to the plaintiff agreeable thereto. All though of times requested to make and executed a Deed of Conveyance to the said land by the plaintiff agreeable to said covenant, but to do and perform the same the said defendant hath altogether refused and still doth refuse to the damage of the plaintiff one thousand dollars and therefore he brings his suit. Pledges to prosecute. [Ples. Non est. Factum and Issue] And the said John Lancaster, by his attorney Howell Tatum Gentleman comes and defends the force and injury when Etc and for Plea saith that the said Hardy ought not have or maintain his said action against him, because he the said John Lancaster saith that the covenant stated and charged in the Declaration of him the said Hardy, is not his Deed, and of this he puts himself upon the Country. And the said Hardy likewise.[2nd Plea, Covenant Performed]... And the said John, by his said Attorney, for further plea to the action of him the said Hardy saith, that after selling and delivery of the Deed of Covenant of him the said John Lancaster, to the said Hardy, (if any such was sealed and delivered) he the said John and Hardy came to an agreement for the amount of damages sustained by the said Hardy by reason of the non performance of his, the said John, Covenant and agreement when and where the aforesaid Hardy (pg. 446) undertook and agreed to receive from him the said John four cows and calves and twenty shillings in full for the damages so by him sustained as aforesaid and in full for the damages so by him sustained as aforesaid and redeliver the Covenant aforesaid to him the said John which he failed to do, and said John in fact saith that he did pay, delivered and satisfy the said Hardy the aforesaid four cows and calves, and the aforesaid sum of twenty shillings; and therefore the said John saith that he hath performed his Covenant, and this he is ready to verify and proven, wherefore he prays Judgment whether the said Hardy ought to have or maintain his action aforesaid against him etc. [3rd. Plea, Covenant, performed]And for further plea, the said John, by his said attorney, saith that shortly after the date of his Covenant, or Deed was sealed and delivered to the said Hardy, he the said John purchased from the said Hardy the land covenanted to be conveyed by the said John to the said Hardy, to wit, on the (?) day of in the year of our Lord seventeen hundred and eight nine (1789) for the price of four cows and calves and twenty shillings the value of the land, being rated by the said agreement at one dollar and one fourth per acre, and cows and calves at the price of fifteen dollars, or six pounds current money, for each cow and calf, and that he paid and satisfied the said Hardy in cows and calves and money to the full amount of price agreed on for the said land, to wit, sixty two dollars and one half, being twenty five pounds current money and the said Hardy was to have redelivered the Covenant aforesaid to the said John, in consideration thereof and therefore the said John saith that he hath performed his covenants fully with the said Hardy; wherefore he prays judgment whether the said hardy ought to have or maintain his action aforesaid against him etc. And the said John, by his attorney aforesaid, for further plea saith that he hath not broke the said Covenant, in manner and form as the said Hardy above complains against him; and of his he puts himself upon the Country etc. and the said Hardy likewise. [Replication to 2nd. Plea. Etc] The plaintiff, by his said attorney, for replication to the second plea saith that there was no agreement made to account for the damages sustained by the plaintiff for the non-performance of the defendant nor neither side the plaintiff were agreed to take four cows and calves and twenty shillings for the damages he sustained for the defendants no complying with his said covenant, nor did he ever receive the said cows and calves and twenty shillings for the said covenant, nor (pg. 447) was agreed to deliver the said covenant to the defendant, nor neither has the defendant complied with his covenant as he hath suggested in his plea and the plaintiff therefore pray the same may be enquired into by a Jury etc. and the defendant likewise. [Replication to 3rd Plea and Issue] The plaintiff, by his said attorney, for replication to the third pleas saith, that the said defendant never purchased the land covenanted to the plaintiff for the price of four cows and calves and twenty shillings, nor there never was a stipulated price agreed on for the value of the land, nor for the cows and calves as mentioned in the plea of the defendant, nor neither did he receive the sixty two dollars and half being the value of the cows and calves and twenty shillings in full for the land to be conveyed, nor never agreed to redeliver to the defendant the said Covenant, for that sum, or upon any other term only a conveyance of the said land agreeable to Covenant, which remains now in full force against the defendant, he not having complied with the same. And therefore preys the same may be inquired into by a Jury etc. and the defendant likewise.[Contces. Jury] And the cause was continued from Term to Term until this Term, to wit, May 1801, and at this time comes the parties by their said attorneys and Jury of Good and lawful men, to wit, James Stuart, John Williamson, David Weakley, John Harpole, Robert Ellis, Andrew Greer, Daniel Mingle, Francis Ury, James Wills, David Cochran, Frances Locke, and James Davis who being elected, tried and sworn to speak the truth upon the issue joined upon their oath do say that the Covenant is the Deed of the defendant and that he has not performed the Covenant in the Declaration, but hath broken the same in manner and form as the plaintiff against him hath complained and they do assess the plaintiffs damages, by occasion thereof, to fifty three dollars and twelve cents besides his costs. Therefore it is considered by the Court that the plaintiff recover against the defendant his damages aforesaid in form aforesaid assessed and his coast by him about his suit in this behalf expended and that the said defendant may be taken etc.[Verdict for Plaintiff, Damages to $53.12, Judgment]

Stephen Robertson complains of John Lancaster administrator of John Lancaster, deceased of a plea of Debt that he render to him the sum of fifteen hundred dollars, which to him he owes and from him unjustly detains for that whereas the said John deceased in his life, to wit, on the thirteenth day of August one thousand seven hundred and ninety eight (1798) at the District aforesaid by his certain writing obligatory, sealed with the seal of the said John deceased the date whereof is the same day and year above mentioned, bound and obliged himself his heirs, ect. to pay the said plaintiff fifteen hundred dollars whenever he should be thereto required and in fact the said plaintiff declares that the said John deceased in his lifetime nor the said John his administrator since his death hath not paid the said fifteen hundred dollars nor any part thereof but the said John deceased in his lifetime, and the said John Administrator; hitherto have refused and still he said John Administrator refuses to pay the same, to the damage of the plaintiff of fifteen hundred dollars and therefore he brings suit etc. pledges ... [OVERTON pro. que-Oyer prayed and had]... And the said John Lancaster by Thomas Stuart his attorney comes and defends the force and injury when and where etc. and craves Oyer of the said writing obligatory, and to him it is read etc. he also prays Oyer of the condition of the said writing obligatory and to him it is read as follows, The condition of the above obligation is such that if the above bound John Lancaster shall well and truly convey or cause to be conveyed a deed in fee simple for three hundred and twenty acres of land lying in the County of Sumner on Smiths fork a fork of Caney Fork River being one moiety of a six hundred and forty acres entered in the name of Sherrod Barrow the south side up the creek, beginning at two beeches running south to a tree called Lynn thence east to a poplar and beach and so on for the complement of three hundred and twenty acres as aforesaid then the above obligation to be void and null otherwise to remain in full force and virtue as witness my hand and seal this August 30th day 1798... [Plea fully administered]... Which being read and hear the said John saith that said plaintiff ought not to have or maintain his said action thereof against him, because he saith he has fully administered all and singular the goods and chattels rights and credits of John Lancaster, deceased (pg. 161) which came into his hands to be administered and has nothing among his hands of said Estate whereby he can make compensation to the said Plaintiff for the breach of said condition of said writing obligatory wherefore he prays judgment if the said plaintiff ought to have or maintain his said action thereof against him[Repn. and Issue]... and the said Stephen says that he by any thing by the said John above alleged ought not to be precluded to have and maintain his action aforesaid against him, because he saith that said John hath not Administered all the singular and goods and chattels of the said John Lancaster deceased which have come to his hands to be administered, as in his plea above he hath alleged and this he prays may be enquired of by the Country. And said defendant also. Additional plea performance of the condition and issue tendered. Issue Joined. -[Contces.]...
