In the name of God Amen.I Hiram Lovelace of the town of Gates in the County of Monroe and State of New York. being of sound mind and memory do make, publish and declare this my last Will and Testament in manner following that is to say
FirstI give and bequeath to my Wife Mary Lovelace all my real estate and personal property to have and hold during her natural life.
SecondI give and bequeath at the death of my Wife all my real estate to my children that is.. Julia A. Barsdale, Nelson G. Lovelace, Harriet E. Congdon and my Grand daughter Frances A. McGonegal to share equal excepting deducting from my daughter Julia’s share three hundred dollars from her share.
LastlyI do hereby nominate and appoint my Wife Mary Lovelace and Henry McGonegal to be the executors of this my last Will and Testament hereby revoking all former Wills made by me.
In Witness whereof I have here unto set my hand and seal this fourth day of June in the year of our Lord one thousand eight hundred and sixty four.

The above instrument consisting of one sheet was at the date there of sealed published and declared by the said Hiram Lovelace as and for his last Will and Testament in presence of us and who at his request and in his and the presence of each other have subscribed our names as witnesses there unto.

Be it remembered that on the day of date here of the last Will and Testament of Hiram Lovelace late of the town of Gates in said County deceased being the foregoing written instrument was duly proved before W. F. Chase Esq. Surrogate of the said County according to law as and for the last Will and Testament of the Real and Personal Estate of said deceased which said last Will and Testament and the proofs and examinations taken thereon are recorded in his office.
The Testimony where of the Surrogate of the said County has here unto set his hand and affixed his seal of Office this 9th day of March 1865

In the matter of proving the Will of
Hiram Lovelace Deceased
County of Monroe SSR. C. Bushnell & John Gardner of the town of Gates in the County of Monroe aforesaid being duly sworn do depose and say that they are the subscribing witnesses to the last Will and Testament of Hiram Lovelace late of the town of Gates in the County of Monroe aforesaid deceased.
And these deponents further say that the said Hiram Lovelace the said testator did in the presence of these deponents subscribe his name at the end of the instrument which is now shown and exhibited to these deponents which purports to be the last will and Testament of the said Hiram Lovelace and which bears date on the 4th day of June in the year of our Lord one thousand eight hundred and sixty four.
And these deponents further say that the said testator did at the said time of subscribing his name as aforesaid at the end of his said Will declare the said instrument so subscribed and now exhibited to his last will and Testament and these deponents did here upon subscribe their names at the end of the said will as attesting witness there to in the presence and at the request of the said testator.

And these deponents further say that at the said time when the said testator so subscribed his name to the said last Will as aforesaid and at the time of these deponents subscribing their names as attesting witnesses thereto as aforesaid the said testator was of sound mind and memory of full age to execute a Will and was not under any restraints and that the said Will now appears in all respects as when so executed without any alterations whatsoever.
