Estates of Wm & Eleanor Beard, Union County, SC

  of 1055

I'm posting this information on several boards and apologize if you have to read it more than once. Thru the generosity of researchers on the Beard rootsweb mailing list I have been able to analyze the wills of this Beard family. I'm quite sure that Eleanor/Ellender Beard Cochran died in Georgia, but the South Carolina Department of Archives did have a few pages of her estate.

Union District, S.C.
William Beard died 1808 with Eleanor, wife and John Beard as Administrators.

Estate of Mrs. Ellendar/Ellendor Cockram, Elenor Beard, Senr., Mrs. Ellen Beard, Elinor Beard, Senr., Ellen Beard (this is all the ways the name of the estate is listed in the copies of papers I received from South Carolina Archives)
Thomas Hollis, Administrator
Thomas Norman, Joseph Harris and Carry Ray appraisers
Appraisment January 16, 1838
Administration Bond issued for $5,000 on Thomas Hollis, John Norman and John Hart witnessed by John Harris
Sale amount of estate $1,112.00
Distribution made as follows:

William Beard: 140.27 paid March 11, 1839

David Norman and wife, Jane Beard daughter of John and Lettie Gregory Beard: 76.66 paid Dec. 20, 1842
J. (John) M. Norman and wife, Susanna Beard daughter of John and Lettie Gregory Beard: 76.66 paid Dec. 20, 1842

Lettie Gregory Beard married as her second husband, John Norman. No known children born to them. John Norman and Lettie Beard entered into an agreement in 1831 regarding the care of her children that are named in the agreement. It appears that John Beard's children received a higher proportion than the other children/grandchildren.

Children of John and Sarah Beard Mares/Mars
William Mars: 23.45 paid Mar. 11, 1839 (William Mars died 1861 names his sister, Patsy Rice in will)
Robert Mars for Robert Mars, Mary Ann Anderson, J. A. Mars, Patsy E. Rice, Sarah M. Abrams: 117.27 paid Jan. 23, 1839

Patience Landrum paid Jan. 23, 1839 amount blurred

Jason Norman and wife (Mariah Harris (b.1802), granddaughter named in Eleanor Beard's will): 34.87 paid Jan. 23, 1839

Children of Edmond Simpson and Unknown First Name Beard
William Simpson: 34.87 paid Feb. 16, 1839
Samuel Simpson: 34.87 paid Feb. 16, 1839
Mary (Simpson) Campbell: 34.87 paid Aug. 27, 1841
(I note with interest that the amounts paid to the Simpson children and Jason Norman and his wife were exactly the same. Also, Jason Norman was named guardian of Edmond Simpson, Jr. when Edmond Simpson, Sr. died in 1835. Was Edmond's second wife the mother of Mariah Harris?)

Franklin Beard and also listed as Franklin Norman in papers was a minor and his share of $77.00 was showing as still in hands of administrator on March 8, 1845. (This is likely Robert J. Franklin Beard son of John and Lettie Gregory Beard)

Thomas Hollis, administrator of this estate married Anna Beard Pearson as his second wife and her second husband. Samuel Pearson, named as a son-in-law in Eleanor Beard's will, died shortly after his mother-in-law in October 1823. Although no amount of money is listed in the estate papers being paid to Thomas Hollis, it would seem from the addition of all the monies, that a share of approximately $140 should have been received by them.

Eleanor Beard, who was widow of William Beard deceased 1808, made her will in 1823 in Union County, SC. In this will she names the following heirs:

Sons-in-law:
Edmond Simpson
David McGummery (this is probably Montgomery)
James Martin
John Mares, wife Sarah (he gets land near Newberry on Duncan's Creek),
Eleanor Cockram daughter and wife of Jacob, to receive $300
eldest son, John Beard
Wm Beard, son
Ann Pearson wife of Samuel
Patience Landrum wife of Micaijah,
grandchildren James H. Harris and Mariah Harris.

Eleanor Beard, Jr. married Jacob Cochran in March 1822 (from Cochran family bible records & Hall County, GA records) and was living in Hall County, Georgia in 1830 census shown as age 50-60. I do not believe she was a widow when she married Jacob Cochran or that she had any children (if she did, then, why was her estate distributed to her living brothers, sisters, nieces and nephews) and I believe she was living with her mother in the 1820 census in Union County, SC.

What seems to be missing from the distribution of Ellender Cochran/Elenor Beard, Sr. estates is any monies to children of David Montgomery and James Martin. Who were their wives?

A John Beard who made his will in 1798 and was recorded in 1804 in Newberry County, SC, names the following heirs: Agnes Gordon, daughter and her daughter Jane; Jennet Richy, daughter—her husband John; Jane Montgomery and her daughter Jane; Margaret Campbell (no relation listed) one-half her mother's pewter; Elenor, daughter (under age); John Beard Richy, grandson. Executrix, Elizabeth, wife and Executor, David Montgomery. Thomas Campbell, witness.

I find it quite odd that there is a David Montgomery with Jane in this will of John Beard and that Eleanor Beard in 1823 named one of her sons-in-law as David Montgomery. Also, that this John Beard had a daughter named Eleanor.

I welcome any comments, additions, corrections. If anyone has proof of all the daughters of William and Eleanor Beard, please contact me.

Thank you,
Cynthia
