Berks County Deed Book 57, pages 99-100:
This Indenture Made the fourth day of April in the year of our Lord one
thousand Eight hundred and Forty Between Joseph McCurdy of Chester County and
Mary his wife,
Peter Ream of Lancaster County and Esther his wife, late Esther McCurdy,
Daniel McCurdy, James McCurdy, and Ann McCurdy widow, late the wife of Davis
McCurdy, deceased, all the heirs and Legal representatives of James McCurdy
late of Berks County, yeoman, deceased, of the first part, and Peter Witman
and James Oneal Junr. both of Carnarvon Township Berks County and State of
Pennsylvania yeoman of the Second partWitnesseth That the said
Joseph McCurdy and Mary his wife Peter Ream and Esther his wife, Daniel
McCurdy James McCurdy and
Ann McCurdy for and in consideration of the sum of one hundred and fifty
dollars Lawful money of the United States of America unto them well and Truly
paid by the said Peter Witman and James Oneal Junr. at or before the sealing
and delivery of these presents, the receipt whereof is hereby acknowledged,
have granted, bargained, sold aliened, enfeoffed, released, conveyed, and
confirmed, and by these presnts do grant, bargain, sell, alien, enfeoff,
release convey and confirm unto the said Peter Witman and James Oneal Junr.
their heirs and assigns All the certain messuage and Tract of Land Situate in
Carnarvon Township Berks County and State aforesaid, bounded and
Limited as follows, to wit.Beginning at a stone in the public road Leading
from the Jones’s Mines to Springfield by a corner of Col. Thomas Bull
deceaseds Land thence by the same south nineteen degrees and one half West
forty six perches and one half west forty six perches and one half to a stone
thence by Land of John Likens
South sixty-Eight degrees and one half East fifty two perches and seven
tenths to a stone thence by other Land of the said Peter Witman the three
following courses North eighteen degrees and one half East twelve perches and
two tenths to a stone North sixty seven degrees and one half west twenty five
perches to a stone thence North twenty degrees East thirty four perches and
six tenths to a planted stone in said public road a corner of James McCormick
and Daniel Ubil’s Land thence a Long said public road by Land of said Daniel
Ubil North
Twenty degrees west fourteen perches and one half to the place of Beginning
Containing Six acres be the same
more or Less it being the same premises which Daniel Ubil and Esther his
wife, Benjamin Talbot and Mary his wife by their Indenture bearing date the
twenty third day of December in the year of our Lord one thousand eight
hundred and thirty six for the consideration therein mentioned granted and
confirmed unto James McCurdy,
Joseph McCurdy and Esther McCurdy now Esther Ream parties hereto and to their
heirs and assigns for ever. Relation being had to the said recited Indenture
will more fully appear Together with all and singular the improvements
ways waters water courses rights liberties privileges hereditaments and
appurtenances whatsoever thereunto belonging. or in anywise appertaining and
the reversions and remainders rents Issues and profits thereof and all the
Estate right, title, interest, property, claim and demand whatsoever of them
the said Joseph McCurdy & Mary his wife Daniel McCurdy James McCurdy & Ann
McCurdy in Law equity or therwise howsoever of in and to the same and every
part and parcel thereof.To have and To hold the said messuage tenement and
Tract of Land containing Six
acres more or less as above described hereditaments and premises thereby
granted or mentioned and intended so to be with the appurtenances unto the
said Peter Witman and James Oneal Junr. their heirs and assigns forever.
And the said Joseph McCurdy & Mary his wife Peter Ream & Esther his wife
Daniel and James McCurdy and Ann McCurdy their heirs Executors and
administrators do by these presents covenant grant and afree to and with the
said Peter Witman and James Oneal Junr. their heirs and assigns that they the
said Joseph McCurdy, Peter Ream, Daniel McCurdy James McCurdy and Ann McCurdy
theirheirs all and Singular the herditaments and premises herein above
described and granted or mentioned and intended so to bewith the
appurtenances unto the said Peter Witman and James Oneal Junr. their heirs
and assigns against them the said Joseph McCurdy and Mary his wife Peter
Ream and Esther his wife Daniel & James MCCurdy & Ann McCurdy their heirs and
against all and every

other person or persons whomsoever Lawfully claiming or to claim the same of
any part thereof by from or under him them or any of them shall and will
warrant and forever defend.In witness whereof the said parties to these
presents have hereunto interchan geably set their hands and seals.Dated the

M. McCurdy {SEAL} guardian duly appointed by the orphans court of Lancaster
County & certificate dat. 20th June 1841 for the orphans children of Davis
McCurdy deceased, to wit Talbot J. Collins & Robert McCurdy Sealed and
delivered in the presence of us Evan Evans Received the day of the date of
the above Indenture of the above named Peter Witman and James Oneal Junr. &
the sum of one hundred and fifty dollars, in full of the consideration money
above mentioned Daniel U. McCurdy Peter Ream Jun. Joseph McCurdy witness
present at Signing Evan Evans, Berks County ss on the Fourth day of April
Anno Domini one thousand Eight hundred and forty before me Evan Evans one of
the Justices of the Peace in and for the said
County personally appeared the above named Joseph McCurdy Peter Ream Daniel
McCurdy James McCurdy & Ann McCurdy and Mary and Esther their wifes and in
due form of Law acknowledged the above Indenture to be their act and deed and
desired the same might be recorded as such and the said Mary and Esther being
of full age and separate and apart from her said husband by me therein
privately examined and the full contents of the above Deed being by me first
made known unto her did thereupon declare and say that she did voluntarily
and of her own free will and accord sign seal and as her act and deed deliver
the above written Indenture Deed or conveyance without any corecion or
compulsion of her said husband Witness my hand and seal the day and year
aforesaid. Evan Evans {SEAL} This is to certify that Evan Evans sold a Tract
of Land Situate in Carnarvon Township Berks County as the Agt. & by Pwer of
Attorney for the heirs of James McCurdy deceased to Peter Witman and that the
said Evan Evans has paid all of the heirs their Separate shares in full
except the sum of twenty Eight dollars James McCurdy’s Share who was then and
still is absent.
I do therefore acknowledge to have received the twenty Eight dollars from the
said Peter Witman by the hands of James Oneal and further I do hereby
indemnify the said Peter Witman his heirs and assigns from the payment
of the said twenty Eight dollars or any part thereof and from all suits and
Costs trouching or concerning the same Witnesseth my hand the 12th day of
March A.D. 1841.Evan Evans

Know all men by these prsents that I Peter Witman one of the grantees within
named and Jane his wife for and in consideration of the sum of Seventy five
dollars to them in hand paid by the within named James Oneal Hunr. at and
before the ensealing and delivering hereof the receipt whereof is hereby
acknowledged
have granted, bargained, sold assigned and set over and by these presents do
grant bargain sell assign and set over unto the said James Oneal his heirs
and assigns all that the one undivided moiety a half part of the within-
mentioned messuage tenement and tract of Land containing Six acres more or
Less.Together with all and Singular the rights members and appurtenances
whatsoever thereunto belonging or in any wise appertaining and the reversions
and remainders, rents, Issues and profits thereof To have and To hold the
said one undivided moiety and half part of teh said messuage tenement and
tract of Land hereby granted and assigned or mentioned or intended
so to be with the appurtenances unto the said James Oneal his heirs and
assigns to the only proper use and behoff of the said James Oneal his heirs
and assigns forever And the said Peter Witman and his heirs the said hereby
granted and assigned premises with the Appurtenances unto the said James
Oneal his heirs and assigns against him the said Peter Witman his heirs and
assigns and against all and every other person or persons whomsoever lawfully
claiming or to claim by from or under him them or any of them shall and will
warrant and for ever defend by these
presents.In witness whereof the said Peter Witman and Jane his wife have
hereunto set their hands and seals the twenty first day of May in the year of
our Lord one thousand Eight hundred and forty two.Peter Witman {SEAL} James
Witman {SEAL} Signed Sealed and delivered in the presence of us Evan Evans.
Received the day of the date of the above written Indenture of assignment of
and from the above named James Oneal Junr. the sum of Seventy five dollars in
full of the consideration money above mentionedPeter Witman.Witness
present at Signing Evan Evans Berks County.
Be it remembered that on the twenty first day of May A.D. 1842 before me Evan
Evans one of the Justices of the Peace in and for the said County Came the
above-named Peter Witman and Jane his wife and scknowledged the above written
Indenture of assignment to be their act and deed and desired that the same be
recorded as such the said jane being of full age and by me duly examined
separately and apart from her

said husband and the contents thereof being first made known to her declared
that she did voluntarily and of her own free will and accord seal and as her
act and deed deliver the said Indenture of assignment without any coercion or
compulsion of her said husband.In testimony whereof I have hereunto set my
hand and seal the
day & year aforesaid.
