April 28, 1751. John McEvers, of New York City, merchant; will of. I desire to be laid to rest in my vault in the Trinity churchyard by the side of my late wife Catherine. Children - William, Charles, Mary, John, James, and Catherine Bayard; each to have 500 pounds., Rest of my real and personal estate to go to my children. The 300 acres given to my son William at Rocky Hill by his uncles Andrew and Abraham Van Horne, my wife and myself, he must put in my general estate to, be divided among his brothers and sisters, or I cut him of any of my estate, for I desire what was left their mother by father, John Van Horne, and my estate, shall go amongst all my children equally. The house where Judah Hays lives in must not come in a division, it being given to my son John by his grandfather. To my present wife Catherine, late widow of Peter Cock, 50 pounds yearly. To daughter Catherine Bayard the house James Clayton lives in, and after her death, to her eldest child. Whereas my brother, Cornelius Van Horne son and heir of his father, John Van Horne, deceased, did assign to me Oct. 5, 1750, a deed of land purchased by his father from Mary Stout, wife and attorney of Harmon Stout, of 607 acres in Middlesex Co., New Jersey, near Milstone River, to be sold by me in trust for the use of our niese and "couzen", Catherine Van Horne, daughter of Andrew Van Horne, my ex'rs are to alien same.

Executors - my sons John and James, daughters Catherine Bayard and Mary McEvers, and my son Charles.

Witnesses: Archibald Fisher, Isaac Goelet, Henry Bogert.

Proved April 6, 1752.

Dec. 14, 1751. John McEvers one of the executors was sworn.
