Asheville, Sept. 16- A special to the Asheville Observer says:
The jury in the case of ERNEST THOMPSON, of Old Fort, against the Southern Railway company, returned a verdict this afternoon in favor of the plaintiff, awarding him $27,500. Nine of the jurymen stood out several hours for $30,000. The suit was for $50,000. ERNEST THOMPSON, a boy 18 years old, living at Old Fort, was injured on a turn table owned by the railway six years ago. Several small boys, including the plaintiff's younger brother, were playing on the turn table. In turning it around the plaintiff's brother was in imminent danger of being crushed.
The plaintiff, then 12 years old, rushed to the rescue and in saving his brother, was permanently injured. Negligence on the part of the defendant company was alledged by reason of failure to keep the turn table locked. The case was tried before Judge Boyd.
