William H. Nichols - EXCHANGE HOTEL, ORANGE CO., VIRGINIA
This Indenture made this 29th day of August one thousand eight hundred forty three Between Richard Rawlings of the first par, Philip S. Fry of the second part and WILLIAM H. NICHOLSof the third part Whereas the said Richard Rawlings is indebted to the said WILLIAM H. NICHOLS in two single bills of nine hundred dollars each, bearing ____date with these presents, the one payable on the 28th day of August next and the other on the 28th day of August then after being the two last payments for the purchase of the Lafayette hotel and lot thereto attached at the Orange Court House, by said Rawlings of the said Nichols and the said Richard Rawlings is decision of security the payment thereof by conveying the said Philip S. Fry the Real Estate herein after mentioned in Trust for that purposeNOW this Indenture Witnessed that the said Richard Rawlings in consideration of the premises and the sum of one dollar to him in hand and paid by the said Phillip S. Fry before the Sealing and Delivery of these presents, the receipt whereof acknowledge hath granted, bargained and sold and by these presents doth grant bargain and sell unto the said Philip S. Fry his heirs and assigns forever the House and Lot at Orange Court House formerly known as the Lafayette Hotel, but now as THE EXCHANGE HOTEL with all the singular the privileges, improvements and appurtenance thereunto belonging or in any ____ appertaining being the same conveyed to the said Richard Rawlings by the said WILLIAM H. NICHOLS by Indenture bearing date with these presents ____. To have and hold the same to himthe said Philip S. Fry his heirs and assigns forever ___ on Trust nevertheless that the said Philip S. Fry shall permit the said Richard Rawlings his heirs or assigns to remain in quiet and peaceful possession of the Hotel and Lot herein conveyed and take to himself the profits thereof until default be made in the payment of the said two single bills and then upon the further trust that the said Philip S. Fry or in the event of his death, his executors or administers shall thereto or when thereto require by the said WILLIAM H. NICHOLS his Executives, Administration or Assigns after having fixed the time and place of sale and given thirty day notice thereof by advertisement of some newspaper published in the town of Fredericksburg or City of Richmond, proceed to sell to the highest bidder at public auction upon the premises for ready money, the estate herein conveyed, and out of the precedes arising from the said sale in the first place pay the cost and charges attending the execution of this trust, then pay and satisfy the said WILLIAM H. NICHOLS, the single bills aforesaid hereby intended to be secured, or __ part thereof may remain unpaid with all interest which may be due thereon or to such other person as may be authorized to receive the same and any surplus which may remain pay to the said Richard Rawlings his Executor, Administrator or Assigns on testimony whereof the parties have hereunto set their hands and seals the day and year first herein written.
