Isaac West m Elizabeth Stults of Highland Co OH

Family researchers have always said Isaac West [s/ Joseph West & Judith BALLINGER] married Elizabeth STULTS and had 6 children.
Isaac's 6 heirs are named in a chancery suit in 1856 concerning land his brother had owned before he died without issue. The marriage is recorded in Highland Co OH.

Correct, as far as it goes...

BUT, I question, was Isaac's wife Elizabeth STULTS ... or ... Mrs. Elizabeth Stults, and there is an error in her surname? And did Isaac have a second wife who was the mother of his 2 youngest children?

There is a series of Highland Co OH deeds in 1846 concerning sales of a '1/9 interest in an undivided 69-1/2 acres of land,' all being sold in separate deeds to George Hook.

4 parts of those '1/9 interest in an undivided 69-1/2 acres of land' belonged to children of Isaac West who had married an Elizabeth Stults. He had 6 children, so I think that indicates he had a second wife and only the first 4 were Elizabeth's children, as 2 of Isaac's children are not mentioned, but living.

BUT, for those 4 West siblings to be have an equal share to Debora STULTS [m George Snider 31 Jan 1828], Margaret STULTS [m Jacob Easter 5 May 1825], Susannah [m Daniel Snider 11 Aug 1833], Mary STULTS [m Robert Cummins 27 Sep 1829], Sarah STULTS [m Peter Burnett 10 Mar 1832], one would think Isaac's wife was married to a Stulz before he married her, and it is 'her' 5 STULTS children that are these heirs, along with her 4 West children. [Isaac West m Elizabeth Stults 20 Jun 1816]

All these marriage dates to STULTS women were in Highland Co OH marriage records, but their husbands are named in the deeds. I looked them up to see who the women were, and they were all STULTS, except Isaac's kids, and he had been married to an Elizabeth Stults.

If Elizabeth was a sister to the other STULTS women in these deeds, then her share should have been divided between her heirs, her 4 West children, not a case of each of them given an equal share with the other STULTS women, unless the West children are siblings of the STULTS women.

Thus my theory above.

Other WEST researchers are not giving Isaac a second wife, and definitely not giving Elizabeth a first husband, and thus a different surname. If so, it is a big error, family secret, etc, that needs to be revealed.

I am working with deed 'abstracts' so maybe I am missing some point that would be in the full deeds.

I would love to discuss this with anyone who has an interest, or more information on the families.

Evelyn
