Was Jacob actually awarded custody or was he declared Guardian for the children?

Guardianship was awarded for minors who stood to inherit some amount of money or goods, and it was awarded to the person the court felt would best look after their interests.
If the probate/estate proceeding for their inheritance was to take place in Georgia, then it made perfect sense for a responsible relative in Georgia to be named guardian to insure the children got what was due them. It did not necessarily imply physical custody of the children.
