THIS INDENTURE made the twenty seventh day of January in the year one thousand eight hundred and fifty three
BETWEEN Robert N. PALMER, Referee in the action hereinafter mentioned of the first part and Isaac STORMS and Jacob STORMS both of the town of Pleasant Valley, County of Dutchess and State of New York of the second part
WHEREAS at a Special Term of the Supreme Court of the State of New York held at the town of Poughkeepsie Dutchess County on the twentieth day of September one thousand eight hundred and fifty three it was among the things ordered adjudged and decreed by the said Court in a certain action then pending in the said Court between Isaac STORMS and Phebe Jane, his wife, Plaintiffs against Keziah STORMS, Jacob STORMS and Catharine, his wife, Abraham STORMS and Elizabeth, his wife, Seneca FOWLER and Nelly, his wife, Gabriel HILL and Sarah, his wife, Thomas LEWIS and Mary Jane, his wife, Orrin CANTINE and Lucy, his wife, Matilda STORMS, William STORMS and Susan, his wife, Bartlett H. BISHOP and Euphemia, his wife, Jacob BISHOP and Sarah, his wife, Ellen BISHOP, Sally Ann BISHOP, Catharine Bishop and James BISHOP, defendants.
THAT all and singular the premises mentioned in the complaint in said action and hereinafter described be sold at public auction according to the course ? and practice? of said court by or under the direction of said Robert N. PALMER who was appointed as Referee in said action and to whom it was referred by the said order and judgment of the said Court among other things to make such sale
THAT the said sale be made in the County where the said premises or the greater part thereof are situated
THAT the Referee give public notice of the time and place of such sale according to law and the course and practice of said law and that any of the parties in said action might become a purchaser or purchasers on such sale
THAT the said referee after said sale make report thereof to said Court and after his report of sale shall have been duly confirmed, then
THAT he execute to the purchaser or purchasers of the said premises or such part or parts thereof
as should be so sold, a good and sufficient deed or deeds of conveyance for the same, and
WHEREAS the said Referee in pursuance of the order and judgment of the said Court did on the fifth day of September one thousand eight hundred and fifty two sell at public auction at the court house in the Village of Poughkeepsie in the County of Dutchess & State of New York the premises in the said order and judgment mentioned and notice of the time and place of such being first given agreeably to the said order
AT WHICH SALE the hereinafter described premises were struck off to the said parties of the second part for the sum of three hundred and forty dollars, that being the highest sum bidden for the same and the said Referee's Report of said sale having been duly confirmed
NOW THIS INDENTURE WITNESSETH that the said Referee, party of the first part to these presents in order to carry into effect the sale so made by him as aforesaid in pursuance of the order and judgment of the said Court and in conformity with the statue in such case made and provided and also in consideration of the presences and of the said sum of money so bidden as aforesaid being first duly paid by the said parties of the second part, the receipt where of is hereby acknowledged
HATH bargained and sold and by these presents doth grand and convey unto the said parties of the second part and to their heirs and assigns forever
ALL THAT CERTAIN PARCEL OF LAND lying, being and situate in the Town of Pleasant Valley in the County of Dutchess owned and occupied by Jacob STORMS now deceased and bounded generally as follows
ON THE north and east by land of Henry PETERS, on the South by lands of Charles PELLS and lands late of Samuel FOWLER, deceased and west by the highway, land of Gilbert INGRAHAM, lands of Jacob STORMS and land of Seneca ODELL, CONTAINING 20 acres of land or thereabouts (see footnote) TO HAVE AND TO HOLD all and singular the premises above mentioned and described and hereby conveyed or intended to be unto the said parties of the second part and to their heirs and assigns to them and each of them and their only proper use and benefit and behoof forever.
IN WITNESS WHEREOF the said party of the first part Referee as aforesaid hath hereunto set his hand and sel the day and year first above written.

Footnote: The deeds conveying this land to Jacob STORMS, deceased were never recorded per the complaint.There were however 4 deeds from various parties referenced in the complaint - Grantors included Samuel M. SMITH and Catharine, his wife (April 1, 1807), Refine WEEKS & Margaret, his wife (April 16, 1811), Solomon OAKLEY and Sarah, his wife (May 7, 1825), and Archilbald COLWELL & Sarah his wife (May 17, 1825).
