Last Will and Testament of Jacob TEAFORD (born ca. 1768) 22 January 1840

In the name of God Amen, I Jacob Teaford of the county of Augusta and state of Virginia being low in health but of a sound and disposing memory and understanding considering the certainty of death and the uncertainty of the time thereof and being desirous to settle my worldly affairs and thereby be the better prepared to leave this world when it shall please god to call me hence I do therefore make and publish this my last will and testament in the manner and form following that is to say first and principally I commit my sole to the hands of god that gave it and my body to the earth to be decently buried at the direction of my executor hereinafter mentioned or named and after my debts and funeral expenses are paid it is my wish and desire that Mary Ann Cook daughter of George Cook have one thousand dollars to be paid to said Mary Ann Cook when she arrives to the age of twenty-one by my executors with the interest on the same yearly which sum I will and bequeath unto the sd Mary Ann Cook to her and her heirs forever. I also will and bequeath unto the sd Mary Ann Cook one half of the hire of my boy Ben for six years which by my executors is hire out yearly and not to the turnpikers or iron works which hire or one half my executors is to pay to the said Mary Ann Cook yearly. I will and bequeath unto Sarah Catharine Cook daughter of said George Cook one thousand dollars with the other half of the hire of my boy Ben for six years to be paid unto the said Sarah Catharine Cook by my executors in the same manner and way that I have described they shall pay to Mary Ann Cook which sum I will and bequeath unto the said Sarah Catharine Cook to her and her heirs forever. I will and bequeath unto Samuel Cook son of the said George Cook one hundred and fifty dollars to be paid by my executors unto the said Samuel Cook with interest when he arrives to the age of twenty-one. I also will and bequeath unto William Cook son of sd George Cook one hundred and fifty dollars to be paid in the same manner and way as above stated. I also will and bequeath unto Paul Alexander Cook son of George Cook two hundred dollars to be paid unto the said Paul Alexander Cook in the same way and manner above stated. I will and bequeath unto Margaret Eve Cook daughter of the said George Cook three hundred dollars to be paid in the same manner and way as above stated that is my executors is to keep all monies out on interest and pay the interest yearly to each legatee until the legatee arrives to the age of twenty-one and then they are to have their full sums paid. And if there should be any moneys left I wish my executors to make an equal division among my legatees above named. I also wish and desire that my boy Ben be free after six years serving after my death that is if he can get liberty from the court to remain in this county. If the court will not grant him liberty to remain in Augusta County, and he still remains here I will bequeath the said Ben to Mary Ann Cook and Sarah Catharine Cook to them and their heirs forever. If Mary Ann Cook or Sarah Catharine Cook should die before they arrive to the age of twenty-one without children or issue I wish the survivor to inherit the others legacy. I do now hereby constitute William A. Hanger my sole executor of this my last will and testament revoking and annulling all former wills and testaments by me heretofore made ratifying and confirming this and no other to be my last will and testament and in Testimony whereof I have hereunto set my hand and affixed my seal this twenty-second day of January one thousand eight hundred and forty.

Augusta County Court February Term 1840

This last will and testament off Jacob Teaford Sr. dec'd was presented in court and proved by the oaths of Jonathan Shirley and John Keller two of the subscribing witnesses hereto and ordered to be recorded. And on the motion of William A. Hanger the executor herein named who made oath hereto according to law and with William A. Bell and John Keller his securities entered into and acknowledged a bond in the penalty of ten thousand dollars conditioned as the law requires which bond is ordered to be recorded. Certeficate is granted the said William A. Hanger for obtaining a probat of said will in due form.
