Be it remembered that this cause came in again to be heard on this 7th day of April 1857 before the Hon R. P. Loyd Judge of the County Court presiding at Pikeville upon the Bill and exhibit A filed in the pleadings of this cause. When it appeared to this that copys & subpoenas had been reasonably issued and served upon the defendants in this cause regaining them to appear at the March term of this court then to plead answer or demer to the bill filed in this cause against them. And it further appearing to the court that the defendants have failed to make defense in said cause, It is therefore ordered by the court that judgment be ordered against the said defendants ?????????. But because it does not appear whether or not is any debts filed against said estate or whether or not said land cannot be advantageously divided amongst those entitled to the same, It is further ordered by the Court that the Clerk of this Court take proof & Report to the present term of this court
First, whether or not the decedent secured and possessed of a general warranty title to the land mentioned in the deed herewith filed marked as exhibit A in this Bill.
2nd If so whether or not the two thingsrds of the same. After the compl????, Susan shall be endowed can be advantageously divided amongst those entitled.
3rd Wheter or not there is any outstanding debts against said deed.
All other matters reserved until the ???????? in of said report.

This day the R????? ????? County presented his Report to the court which report being unaccepted to be read by the court and ordered to be filed by the Clerk.

Be it remembered that this cause came again to be heard upon the Repport of the Clerk of this county from which Report the proof taken then. It appears to this court that said Jacob Teater did secure and possess of good general warranty deed to all of the land in the deed filed in this cause marked as exhibit A. It further appearing to the Court from said report that there is not outstanding debt filed against said estate and there is no administration in said estate granted by the court, and it further appearing to the court from the allegations in said Bill that there was but little personal property of any kind belonging to the deceased at his death and that the heirs and distributees have used and come the same in paying off and discharging the liabilities of the deceased that have accrued before and since his death. And it further appearing from the allegations in said Bill that the heirs and distributees are all of full age. All of which appearing from the pleadings and report of the Clerk to the present term of this Court and all the allegations in said Bill having been taken ????????? & the report being accepted to is in all things confirmed. And it further appearing to this court that the said Susan Teater is the widow of said deceased is intittled to ???? out of the land of her deceased husband at his death. It is therefore adjudged and decreed by the Court that Thomas A. Pope, Byrum Heard & Thomas G. Brown the County Surveyors be and they be appointed commuprend to go upon the land of the said deceased and enter in the placing and set apart to the widow Susan and complainants one third part of all the Real estate of the said Jacob deceased sized and poled off and marked thereof to the next term of this and that all other matters in the Bill be held in reserve until the cemeny in of said report.

Loyd on this 4 day of May 1857 and it appearing to the satisfaction of the Court from the allegations in the bill pleding and the proof in this cause that the that ????? has been assigned to the widow & that the other two thirds of said land mentioned in the pleadings can not be advantageously divided amongst the heirs and distirbutes of the said Jacob Deceased. It is therefore ordered adjudged and decreed by this court that James S. Pankey, Clerk of this Court be appointed special commissioner to go upon the ................ ....60 degrees W 58 Polls to a Stake near the fence thence N 64f degrees W 70 polls to a Stake in a line of condition made by Andrew Darrs thence a direct line to the beginning. And it further appearing to the court from the report of the clerk in this cause that said land was struck off on said day and place to one Edward Sparkman for the sum of $260.50 two hundred and sixty dollars and fifty cents and took his note under for that amount with one Rufus B. Roberson as his Security without interest. It is therefore considered by the Court that all the Right Title Interest Claim and Demand to the before ???????? land be divided out of the heirs & distributes of Jacob Teaters and vested in the Purchaser Edward Sparkman subject however to the ???????? the purchase money as aforesaid and further that the cause remain in court until said note is collected or paid at which time the Clerk is to pay all the cost of this Suit and Fifteen Dollars to James G. Spears for his services in this cause out of the first money collected and after having paid all the costs of this suit.

This day came into open court Rebecca Sparkman wife of Edward Sparkman who after being examined in open court seperate and apart from her husband the said Edward Sparkman and acknowledged that it is her wish the ???? arising from the Sale of the land owned by her dec'd father Jacob Teater when collected be paid to John Teater that she does it knowingly and understandingly and without compulsion, cohersion or restraint in the part of her said husband.

This day Mrs. ........ Smith wife of Bedford Smith who was formerly ....... Teater came into open court and being privately examined seperate and apart from her husband say that she has an interest in the estateof her dec'd father Jacob Teater and that the same is in the hand of the Court Clerk and that it is her desire that the same be paid to her husband Bedford B. Smith that does this knowingly willingly and understandingly without compulsion or restraing in the part of her husband.

This day James S. Pankey Clerk of this court moved the court for judgment against Edward B. Sparkman & R. B. Rberson for the sum of two hundred & fifty dollars and fifty cents with interest from the 31st day of Oct. 1858 for the use of the heirs of Jacob Teaters and after hearing and fully understanding the nature of said motion it is considered by the court that said James S. Pankey Clerk aforesaid for the use of the heirs of Jacob Teaters recover of the said Edward B. Sparkman principle and the said R. B. Roberson his security, the sum of one hundred and seventy four dollars and seventy five cents principle and the further sum of three dollars and forty centy interest on the same making the sum of........
