Ezekiel Daniels b. betw. 1780-1790 NOT s/o Judge James Daniel & Mary Buffington!

I keep seeing some misinformation posted in dozens of online family trees and I want to try to clear it up as best I can. Unfortunately, we will quite likely continue to see the wrong information regurgitated on these Ancestry trees in spite of my efforts here.

Many people have mistakenly listed my 4G-Grandfather Ezekiel Daniels who married Elizabeth Blankenship (who resided at their deaths in Logan Co VA) as being a son of Judge James Daniels and Mary Buffington of Cherokee fame. This is TOTALLY INCORRECT because my 4G-Grandfather Ezekiel Daniels was b. bet 1780-1790 in Virginia. Judge James Daniel and Mary Buffington's son Ezekiel was b. abt 1818 and was married to Neisa Muskrat b. 1822. Ezekiel & Neisa lived in the Georgia Indian territories.

Ezekiel Daniels who married Elizabeth Blankenship was born at least 28 - 38 years BEFORE the son of Judge James Daniel and Mary Buffington was born (see 1830 Logan Co VA Census which lists Ezekiel as being between 40-50 years old), and he and wife Elizabeth Blankenship lived in Logan Co VA (now WV). He can be found in 1810 in Tazewell Co VA (missed muster call for the 112th Regiment of Virginia Militia, see "Archives of the Pioneers of Tazewell Co VA", edited by Netti Schreiner-Yantis, page 162). He is found on Tazewell Co VA Tax lists for 1811, 1812, and 1813. He moved to Cabell Co VA and can be found on the 1820 census there, and in a land survey in 1823, then on the 1830 census for Logan Co VA, which had been a part of Cabell. In short, Ezekiel probably never moved from his homestead, but the county boundaries changed around him, thus changing his county residence. He can then be found in Logan Co VA Tax Lists for 1824, 1833, 1835, and 1837. He acquired Logan Co VA Land Grants in 1824 and 1831.

To sum up, there is absolutely NO PROOF of my 4th G-Grandpa Ezekiel Daniel's parentage except that we know his mother's first name was Elizabeth and that she had died prior to 1827, and that he had a sister named Mary Jane Daniels who was married in Pike Co KY to George McCoy.

(Page 148, last paragraph states):
"81 Robert Buffington Daniel was the eldest son of Judge James Daniel. He was born in January, 1815. In 1847 he was a member of the Cherokee Senate from Delawme District; two years later he was clerk of the Senate. He served as a member of the Supreme Court and the following year he became chief justice. In August, 1871, he was elected second chief. He died January 16, 1872. (O'Beirne.
OP. cit, 259; Starr- op. ck, pp. 264, 255, 273). (YBeirne spelled the name "Daniels.'
